Dear Ms. Jewell:

On December 28, 2002, the Commission Staff filed a Petition requesting that the Commission investigate the buy-back rates contained in the Letter Agreement between Idaho Power Company and Astaris LLC. In support of its Petition, Staff filed several exhibits, three of which, Staff Exhibits 102, 103 and 104, Idaho Power claimed contained confidential information. Respecting this initial assertion, Staff redacted these exhibits prior to sending them to interested parties. On January 4, 2002, the Commission Staff received a letter from Idaho Power Company representing that it no longer maintains that the information contained in Staff Exhibits 102, 103 and 104 is confidential and therefore Staff may release it to interested parties.

Based on Idaho Power’s letter, Staff is providing the Commission with these three exhibits and requests that they be placed in the Commission’s public file. The previous Confidential editions of Staff Exhibit 102, 103, and 104 may be removed from the Commission Secretary’s proprietary file.
