MARCH 28, 2002 RE: IN THE MATTER OF THE PETITION OF THE COMMISSION STAFF REQUESTING THAT THE COMMISSION INVESTIGATE THE LOAD REDUCTION RATES IN THE LETTER AGREEMENT ENTERED INTO BY IDAHO POWER AND ASTARIS LLC.
On March 18, 2002 the Commission issued Order No. 28983 that required the parties to attend a settlement conference to explore the possibility of settling issues in a reasonable, speedy and economical manner. Order No. 28983 at p.2. The Commission scheduled this conference for Tuesday, April 2, 2002 at the Commission’s offices.
In order to aid the exploration of a possible settlement the parties convened at the Commission’s offices on March 26-27, 2002. Although this meeting was worthwhile it ultimately did not produce a settlement of this matter. Staff does not believe that further discussion will lead to a resolution of this case. Accordingly, Staff believes that the meeting scheduled for April 2, 2002 would not serve any purpose. Accordingly, Staff requests that this hearing be vacated. Staff has contacted all the parties in this matter and they have raised no objection to the vacation of this meeting.
