HomeMy WebLinkAbout29040.docBEFORE THE IDAHO PUBLIC UTILITIES COMMISSION IN THE MATTER OF THE APPLICATION OF IDAHO POWER COMPANY FOR AN ORDER APPROVING THE COSTS TO BE INCLUDED IN THE 2002/2003 PCA YEAR FOR THE IRRIGATION LOAD REDUCTION PROGRAM AND ASTARIS LOAD REDUCTION AGREEMENT. ) ) ) ) ) ) ) CASE NO. IPC-E-01-34 ORDER NO. 29040 In March 2001, the Commission approved Idaho Power Company’s Irrigation Load Reduction Program, authorizing the Company to contract with irrigation customers for electric load reduction of at least 100,000 kilowatt hours (“kWh”) during the 2001 irrigation season. Order Nos. 28676 and 28699 (Case No. IPC-E-01-3). On October 19, 2001, the Company filed an Application requesting that the Commission authorize the Company to include the costs of the Irrigation Load Reduction Program in the 2002/2003 Power Costs Adjustment (“PCA”) case. Case No. IPC-E-01-34. On April 15, 2002, the Commission issued Order No. 28992 granting Idaho Power’s request to recover the direct costs associated with the Irrigation Load Reduction Program but denying its request to recover “reduced/lost revenue” that may have resulted from the program’s operation. On May 2, 2002, the Company filed a timely Petition for Reconsideration requesting that the Commission reconsider its decision regarding the recovery of reduced/lost revenues. The Company did not offer any new evidence but stated it is available if the Commission desires to convene a hearing. The other parties in this case have not filed a response to the Company’s Petition. COMMISSION DECISION Pursuant to Idaho Code § 61-626 “within twenty-eight days after the filing of a petition for reconsideration the Commission shall determine whether or not it will grant such reconsideration, and make and enter its order accordingly. If reconsideration be granted, said order shall specify how the matter will be reconsidered[.]” The Commission has determined that the complexity of issues surrounding Idaho Power’s Petition for Reconsideration requires us to thoroughly review the record in this matter in order to render our decision. Based on Idaho Power’s representation and our own determination, we find that the record in this proceeding is sufficient for the Commission to resolve the Company’s Petition. Accordingly, the Commission shall grant Idaho Power’s Petition for Reconsideration for the limited purpose of determining whether based on the record we should modify Order No. 28992 to allow Idaho Power to recover reduced/lost revenues from the Irrigation Load Reduction Program. O R D E R IT IS HEREBY ORDERED that Idaho Power Company’s Petition for Reconsideration is granted. The Commission will review the record in this matter in order to determine whether it should modify Order No. 28992 to allow Idaho Power to recover reduced/lost revenues from the Irrigation Load Reduction Program.
