HomeMy WebLinkAboutmodproc.app.docBEFORE THE IDAHO PUBLIC UTILITIES COMMISSION IN THE MATTER OF THE APPLICATION OF IDAHO POWER COMPANY FOR AN ORDER ESTABLISHING THE MINIMUM ENERGY COST AMOUNT BEFORE ISSUANCE OF AN ENERGY COST FINANCING ORDER. ) ) ) ) ) ) ) ) ) ) CASE NO. IPC-E-01-19 NOTICE OF APPLICATION NOTICE OF MODIFIED PROCEDURE NOTICE OF COMMENT/PROTEST DEADLINE The 56th Legislature of the State of Idaho in its first regular session 2001 enacted a new law to provide for the issuance of energy cost recovery bonds. Reference Idaho Code, Title 61, Chapter 15. The legislation provides electric public utilities with a mechanism for recovery of their increased costs while leveling the rate impact of such increases on the utilities’ customers. Qualifying energy costs are those authorized by the Idaho Public Utilities Commission (Commission) and reflected in a usage-based charge of a public utility: i.e., a fuel or power cost adjustment; …; a commodity electric rate adjustment; or a purchased power tracker rate. Idaho Code § 61-1502(4). Prior to its first Application for an Energy Cost Financing Order, each electric public utility is required to file with the Commission a proposal as to what a minimum “ECA” or energy cost amount (expressed in cents per kilowatt hour) should be. Idaho Code § 61-503. YOU ARE HEREBY NOTIFIED that on May 25, 2001, Idaho Power Company filed an Application with the Commission seeking to establish a minimum energy cost amount. The Company’s filing comports with the requirements of Idaho Code, Title 61, Chapter 15. Idaho Power applies for a minimum energy cost amount of one (1) cent per kWh. The Company reports that based on the 1999 normalized state of Idaho jurisdictional share, the Company under its proposal of one (1) cent per kWh would be receiving $127,704,050 from ECA charges before filing for an Energy Cost Financing Order. YOU ARE FURTHER NOTIFIED that the Commission has reviewed the Company’s filings in Case No. IPC-E-01-19. The Commission has preliminarily determined that the public interest regarding the establishment of a minimum energy cost amount may not require a hearing to consider the issues presented and that the issues raised by the Application may be processed under Modified Procedure, i.e., by written submission rather than by hearing. Reference Commission Rules of Procedure, IDAPA 31.01.01.201-204. YOU ARE FURTHER NOTIFIED that pursuant to Idaho Code § 61-1503(2) the Commission has a statutory obligation to issue an Order regarding its determination of such proposed minimum amount within 28 days of the utility’s filing. YOU ARE FURTHER NOTIFIED that the Commission may not hold a hearing in this proceeding unless it receives written protests or comments opposing the use of Modified Procedure and stating why Modified Procedure should not be used. Reference IDAPA 31.01.01.203. YOU ARE FURTHER NOTIFIED that the deadline for filing written comments or protests with respect to the Application and the Commission’s use of Modified Procedure in Case No. IPC-E-01-19 is Thursday, June 14, 2001. Persons desiring a hearing must specifically request a hearing in their written protests or comments. YOU ARE FURTHER NOTIFIED that if no written protests or comments are received within the deadline, the Commission will consider the issue on its merits and enter its Order without a formal hearing. If comments or protests are filed within the deadline, the Commission will consider them and in its discretion may set the matter for hearing or may decide the matter and issue its Order on the written positions before it.
