IPC-01- (PHASE II) ) THIRD SUPPLEMENTAL ) STATUS REPORT On May 13, 2003 , in compliance with Order No. 29102 , Idaho Power Company ("Idaho Power" or "the Company ) and the Commission Staff jointly filed a Status Report to advise the Commission of the current status of the Parties' efforts to resolve the remaining issues in this case relating to transactions between Idaho Power and IDACORP Energy LP ("IE") under the Agreement For Electricity Supply and Management Services between Idaho Power and I E ("Supply and Management Agreement" THIRD SUPPLEMENTAL STATUS REPORT, Page Since the May 13 , 2003 Status Report, two events have occurred which directly bear on this case. First, in Order No. 29258 in Case No. IPC-03-5, the Commission moved four issues from Case No. IPC-03-5 to this case. These four issues all relate to transactions between Idaho Power and IE and are more particularly described in Order No. 29258 and will not be repeated here. Second , on May 16 , 2003, FERC completed its non-public investigation and issued its Order approving a Stipulation and Consent Agreement between Idaho Power and the FERC Staff. The relationship between the FERC investigation and this case has been discussed at length in prior Status Reports and will not be repeated here. Following the issuance of the FERC's May 16, 2003 Order and Commission Order No. 29258, Idaho Power, the Commission Staff, and representatives from the American Association of Retired Persons, the Idaho Irrigation Pumpers Association, Micron Technology, the IndUstrial Customers of Idaho Power, the Idaho Retailers Association and Jeff Brooks , dba Advanced Energy Strategies , have participated in a series of settlement conferences to resolve the issues identified in the Commission s previous orders , including the relevant issues from the FERC proceeding. Since the last Status Report, the above-referenced Parties have met on June 23 2003, July 1 , 2003 , July 22 , 2003, August 5, 2003 , and August 11 , 2003. While consensus has not been achieved on all items, both Idaho Power and Commission Staff believe that good progress is being made and that a settlement may be achievable. With this in mind , it is Idaho Power s current intention that on or before September 26, 2003 , Idaho THIRD SUPPLEMENTAL STATUS REPORT, Page 2 Power will either file the settlement stipulation described in previous Status Reports or a Final Status Report which would conclude the settlement negotiations.
