NOTICE OF INTERVENTION DEADLINE

On January 18, 2001, Idaho Power Company (“Idaho Power”) filed an Application with the Idaho Public Utilities Commission (Commission) requesting that it issue an order which would approve the Statement of Policy and Code of Conduct addressing transactions between Idaho Power and its affiliate IDACORP Energy Solutions LP (“IES”).
BACKGROUND
In Commission Order No. 28596 issued in Case No. IPC-E-00-13 the Commission authorized Idaho Power to enter into an Agreement for Electricity Supply and Management services (“Agreement”) with IES and stated that the Statement of Policy and Code of Conduct, submitted with the Company’s Application, required further development and the opportunity for public input. Order No. 28596 at 11, Case No. IPC-E-00-13. Accordingly, the Commission directed Idaho Power to make a formal filing within 30 days of any proposed Policy and Code of Conduct for affiliate relationships. Id. In the interim though the Commission found it reasonable that the Company and IES conduct themselves in accordance with the terms submitted.
In the instant Application Idaho Power is offering to put into place a formal Statement of Policy and Code of Conduct which would further define the relationship between IES and itself. Idaho Power states that the attached Statement of Policy and Code of Conduct covering the Idaho Power/IES Agreement has been revised from the original filing to include a number of additions and clarifications that were requested by the Commission Staff. Idaho Power contends that this is a reasonable policy that allows it and IES to operate efficiently under the approved Agreement in Case No. IPC-E-00-13, while at the same time providing Idaho Power customers with additional commitments and protection against inappropriate actions on the part of either Idaho Power or IES.
Staff recommended that the Commission issue notice of this Application and set an intervention deadline for interested parties. Staff recommended that the Commission should order that any party that wishes to intervene must do so within twenty-eight (28) days of issuance of the notice. IDAPA 31.01.01.071-.075.
YOU ARE HEREBY NOTIFIED that all proceedings in this case will be held pursuant to the Commission’s jurisdiction under Title 61 of the Idaho Code and that the Commission may enter any final Order consistent with its authority under Title 61. All proceedings in this matter will be conducted pursuant to the Commission’s Rules of Procedure, IDAPA 31.01.01.000 et seq.
DEADLINE FOR INTERVENTION
YOU ARE FURTHER NOTIFIED that any person desiring to intervene in Case No. IPC-E-01-2 for the purpose of becoming a party, i.e., to present evidence, to engage in discovery, to acquire the rights of cross-examination, to participate in settlement or negotiation conferences, and to make and argue motions must file a Petition to Intervene with the Commission pursuant to Rules 72 and 73 of the Commission’s Rules of Procedure, IDAPA 31.01.01.072-073. Petitions to Intervene must be filed within twenty-eight (28) days of issuance of this Notice.
