ORDER NO. 28339
YOU ARE HEREBY NOTIFIED that on March 28, 2000, pursuant to Order No. 26216 issued in Case No. IPC-E-95-11, Idaho Power Company filed its 1999 Earnings Compliance Filing. Idaho Power indicated in its filing that the total customer revenue sharing amount is $9,025,295.
YOU ARE FURTHER NOTIFIED that the purpose for the filing is to identify Idaho Power’s earnings, and if it exceeds an approved rate of return, to determine the amount to be shared with Idaho Power’s customers pursuant to Order No. 20216.
YOU ARE FURTHER NOTIFIED that Idaho Power stated that in February 2000, it discovered a billing error involving the FMC account and the effect of the error for 1999 was an undercharge for FMC in the amount of $699,284. Idaho Power requests the Commission to approve including an additional amount of $202,407 in the 1999 revenue sharing balance to account for this error.
YOU ARE FURTHER NOTIFIED that Idaho Power stated that in February 2000, it discovered a billing error involving the FMC account and the effect of the error for 1999 was an undercharge for FMC in the amount of $699,284. Idaho Power requests the Commission to approve include in the 1999 revenue sharing balance an additional amount of $202,407 to account for this error.
YOU ARE FURTHER NOTIFIED that Idaho Power reports that as of May 15, 2000 it will have a reserve balance of $240,392 for Agricultural Choices Program payment expenditures which are no longer required.
YOU ARE FURTHER NOTIFIED that in Order No. 28041, the Commission ruled that any amount held in reserve for the Agricultural Choices Program that was not used would be included in the 1999 revenue sharing filing.
YOU ARE FURTHER NOTIFIED that after setting aside an amount for the 1999 NEEA payments, Idaho Power reports that $162,751 will be available for revenue sharing as of May 15, 2000.
YOU ARE FURTHER NOTIFIED that according to Idaho Power, the 1999 revenue sharing balance on May 15, 2000, will be $9,630,845. As provided in Order No. 28099 (IPC-E-99-2), as of May 15, 2000, there will be an amount of $2,704,469 from the deferred 1998 customer revenue sharing which is attributable to customers other than Schedule 19 customers and special contract customers.
YOU ARE FURTHER NOTIFIED that the Commission is currently considering its decision in IPC-E-99-13 (Idaho Power NEEA Application) and that decision may affect the utilization of 1999 revenue sharing amounts. When that decision is issued, the company will submit a recommendation as to any of the uncommitted 1999 revenue sharing funds
YOU ARE FURTHER NOTIFIED that the Commission has determined that the public interest may not require a formal hearing in this matter and will proceed under Modified Procedure pursuant to Rules 201 through 204 of the Idaho Public Utilities Commission’s Rules of Procedure, IDAPA 31.01.01.201 through -.204.
YOU ARE FURTHER NOTIFIED that any person desiring to state a position on this Application may file a written comment in support or opposition with the Commission within fourteen (14) days from the date of this Notice. The comment must contain a statement of reasons supporting the comment. Persons desiring a hearing must specifically request a hearing in their written comments. Written comments concerning this application shall be mailed to the Commission and the Applicant at the addresses reflected below:

YOU ARE FURTHER NOTIFIED that if no written comments are received within the time limit set, the Commission will consider this matter on its merits and enter its Order without a formal hearing. If written comments are received within the time limit set, the Commission will consider them and, in its discretion, may set the same for formal hearing.

IT IS HEREBY ORDERED, based upon the filing in this case and the determination of the Commission, that Idaho Power’s 1999 compliance filing shall be processed by Modified Procedure, IPUC Rules of Procedure 201-04, IDAPA 31.01.01.201-04.
