Dear Sirs:
In response to your letter of April 8, 1996, expressing concern regarding the increase in camping fees for the Hells Canyon Campground facilities, we do not have in our possession any “original agreement” pertaining to the campground. To the extent that such an agreement exists, you might consider reviewing the Company’s Application filed with the Federal Energy Regulatory Commission (the FERC; formerly the Federal Power Commission) and the license issued by the FERC to Idaho Power for the operation of the Hells Canyon Dam and the attendant recreational facilities. We do not know whether these documents would provide you with any useful information but you should be able to obtain them from either Idaho Power Company or the FERC.
Pursuant to Title 61 of the Idaho Code, the primary function of this Commission is to set rates and charges and establish conditions of utility service for, among others, Idaho Power Company. Because the operation of the Hells Canyon Campground, and the setting of fees for the use of that facility, are not integral to the generation, transmission or distribution of electricity, we do not have jurisdiction to regulate those fees.
