GNR-E-11-03 PETITION TO INTERVENE OF CLEARWATER PAPER CORPORATION COMES NOW, the CLEARWATER PAPER CORPORATION, hereinaferreferred to as "Intervenor," and pursuat to this Commssion's Rules of Procedure, Rule 71 IDAPA 31.01.01.71 hereby petitions the Commission for leave to intervene herein and to appear and paricipate herein as a par, and as grounds therefore states as follows: 1. This Intervenor, Clearater Paper Corporation, operates a wood pulp, paperboard, and tissue manufactung facilty near Lewiston, Idaho (hereinafer referred to as the "Lewiston Plant." 3. Clearater Paper Corporation's Lewiston Plant receives electrc and natual gas utilty serices from A vista Corporation ("A vista") pursuat Idaho Public Utilty Commission tarffs. 4. Clearater Paper Corporation owns and operates four generators at the Lewiston Plant that are capable of generating approximately 95 megawatts of energy. These generators are Qualifying Facilties ("QFs") pursuat to the Public Utilty Regulatory Policies Act of 1978. CLEARWATER PAPER CORPORATION PETITION TO INTERVENE PAGE 2 5. A vista purchased the Lewiston Plant generation output and provided electric service to the Lewiston Plant pursuat to a 1992 Electrc Service and Purchase Agreement between the Lewiston Plant's prior owner, the Potlatch Corporation, and Avista (formerly known as "The Washigton Water Power Company"), approved in IPUC Case No. WW-E-91- 5, Order No. 23858. 6. After the 1992 Electrc Service and Purchase Agreement expired, Potlatch Corporation and A vista entered into a 2003 Purchase and Sale Agreement which governs sale of the Lewiston Plant QFs' output to Avista under the Public Utilty Regulatory Policies Act of 1978, approved in IPUC Case No. AVU-E-03-07, Order No. 29418. 7. Clearater Paper Corporation is the successor in interest to Potlatch Corporation's rights and obligations under the 2003 Purchase and Sale Agreement. 8. Clearater Paper Corporation curently owns and operates the Lewiston Plant and its generators, and sells the output from the QFs to A vista pursuant to the 2003 Purchase and Sale Agreement. 9. The 2003 Purchase and Sale Agreement expires on June 30, 2013. 10. Clearater Paper Corporation intends to negotiate a successor purchase and sales agreement prior to expiration of the 2003 Purchase and Sales Agreement. 11. Clearater Paper Corporation claims a direct and substatial interest in ths proceeding because the outcome of ths proceeding is very likely to impact the rates, terms, and conditions available to Clearater Paper Corporation for a successor purchase and sale agreement for its Lewiston Plant QFs. 12. This Intervenor intends to paricipate herein as a par, and if necessar, to introduce evidence, cross-exame witnesses, call and examine witnesses, and be heard in CLEARWATER PAPER CORPORATION PETITION TO INTERVENE PAGE 3 arguent. The natue and quaity of evidence which ths Intervenor will introduce is dependent upon the nature and effect of other evidence in this proceeding. 13. Without the opportty to intervene herein, this Intervenor would be without any means of paricipation in this proceeding which may have a material impact on the rates, terms and conditions under which it is entitled to sell the output of its QFs . 14. Granting this Intervenor's petition to intervene will not unduly broaden the issues nor will it prejudice any par to this case. This Intervenor does not intend to broaden the issues beyond those listed in IPUC Order No. 32352 issued in ths docket. This Intervenor agrees to be bound by all prior orders existing in ths docket prior to its intervention. 15. Although ths Petition to Intervene is fied after the deadline set in Order No. 32352, ths Intervenor requests leave to intervene afer the deadline on the ground that this Intervenor will not raise additional issues and that the matter has not yet proceeded to fiing of testimony. 16. Because this proceeding is very likely to impact the rates, terms, and conditions available for sale of the output of this Intervenor's QFs, good cause exists to grant ths Petition. Granting intervention at this time will not disrupt the proceedings or prejudice any other paries. Intervention is therefore proper pursuant to ths Commission's Rules of Procedure, Rule 73 IDAPA 31.01.01.73. WHREFORE, the Clearater Paper Corporation respectflly requests that this Commission grant its Petition to Intervene in these proceedings and to appear and paricipate in all matters as may be necessar and appropriate; and to present evidence, call and examine witnesses, present argument and to otherwse fully paricipate in these proceedings.
