ldaho Power Company ("ldaho Power") pursuant to RP 68 hereby respectfully
gives this Notice of Withdrawal of Pleading, to withdraw its previously filed Response
and Objection of ldaho Power Company, initially filed in Case No. IPC-E-17-07. The
ldaho Public Utilities Commission ("Commission") previously directed that this pleading
be treated as an application to initiate this docket, Case No. GNR-E-17-02. Order Nos.
33773 and 33778.
ldaho Power has contacted counsel for all parties to this case: Commission
Staff, Avista Corporation, J. R. Simplot Company, Idaho Hydroelectric Power Producers
Trust dlbla ldahydro, Renewable Energy Coalition, Tamarack Energy Partnership, and
Rocky Mountain Power-and all parties stated no objection to ldaho Power's withdrawal
IDAHO POWER COMPANY'S NOTICE OF WITHDRAWAL OF PLEADING - 1
of its pleading and the Commission's closure of Case No. GNR-E-17-02. The
withdrawal of ldaho Power's Response and Objection pleading and the closure of Case
No. GNR-E-17-02 will leave the currently approved published avoided cost rates in
place based upon the calculation set forth in Commission Staff's May 16,2017, letter,
which the Commission found to be "fair, just, and reasonable." Case No. IPC-E-17-07,
Order No. 33773.
WHEREFORE, RP 68 states, "A party desiring to withdraw a pleading must file a
notice of withdrawal of the pleading with the Commission and serve all parties with it.
Unless othenryise ordered by the Commission, the notice is effective fourteen (14) days
after filing." Based upon the agreement of all parties, ldaho Power respectfully requests
that its Response and Objection be withdrawn and that Case No. GNR-E-17-02 be
closed.
