JOE LECKIE EXECUTIVE ADMINISTRATOR DATE: DECEMBER 24, 2012 RE: APPROVAL OF INTERAGENCY AGREEMENT BETWEEN THE OFFICE OF ENERGY RESOURCES AND THE COMMISSION The Commission is hiring Maria Barratt (Ms. Barratt) to replace the retiring David Hattaway. Ms. Barratt is currently employed by the State of Idaho, Office of Energy Resources (OER) as its chief financial officer. She will begin working for the Commission on December 30, 2012. Prior to this time she will spend some time with David Hattaway learning his duties and responsibilities. Additionally, it is anticipated that Ms. Barratt will be needed by OER in finalizing its budgets and complying with reporting and closing out processes of ARRA grants. This requirement of Ms. Barratt's time on less than a full-time basis by OER will continue through June 30, 2013. OER' s needs would not require the full-time attention of Maria, and Maria's duties at the Commission will not suffer if Maria spent some of her work time assisting OER through this transition period. During the period Ms. Barratt is an employee of OER, she will track all time she may spend on Commission matters learning her new position duties. The Commission will then pay to OER according to the terms of the agreement. The compensation paid to OER by the Commission will be equal to the number of hours Ms. Barratt works for the Commission times the total compensation costs of her employment with OER. After Ms. Barratt becomes an employee with the Commission, she will track all time she may incur on OER matters. OER will then pay to the Commission according to the terms of the DECISION MEMORANDUM -1- agreements. The compensation paid to the Commission by OER will be equal to the number of hours Ms. Barratt works for OER times the total compensation costs of her employment with the Commission. The maximum amount that either party shall pay under this agreement to the other party shall not exceed $8,000. Idaho Code §67-2332 allows state agencies to contract with each other to perform "any governmental service, activity or undertaking" which each agency is authorized by law to perform. This stature also requires the "governing body" of each agency to approve the interagency agreement.
