Re: Case No. GNR-E-02-2, Determination of Pole Attachment Rate Formula

Dear Interested Parties:

Last November I informed you by letter that this proceeding to determine a pole attachment rate formula for the Commission to resolve pole attachment rate disputes would sit idle while Cable One and Idaho Power Company proceeded with their pole attachment rate case, Case No. GNR-E-01-02. Cable One and Idaho Power have resolved their pole attachment case by stipulation, and the Commission has dismissed their case. Because the Commission’s authority under Idaho Code § 61-538 is to resolve pole attachment rate disputes, I do not believe there is interest in proceeding with this broader case to establish a rate formula for future disputes. Accordingly, I plan to ask the Commission to dismiss this case.

Please let me know if you have any concerns or objections to the Commission dismissing Case No. GNR-E-02-02. I plan to ask the Commission to close this case next month.
