Higgins, Tribal Attorney Tribal Attorney’s Office PO Box 306 Fort Hall, ID 83203 Re: BPA Inquiry Dear Mr. Higgins: The Idaho Public Utilities Commission received your inquiry regarding the Bonneville Power Administration (BPA) subscription process on December 14, 1999. In your letter, you indicated that the Shoshone-Bannock Tribes were evaluating their ability to participate in the BPA subscription process. You also requested an opinion from the Commission as to “the extent of its authority over tribal lands of the Shoshone-Bannock Tribes.” The Commission has asked me to respond to your inquiry. The Commission is unable to provide you with an opinion regarding the Shoshone-Bannock Tribes’ eligibility to obtain electric power from BPA. Questions regarding the Tribes’ eligibility to participate in the subscription process are more appropriately directed to the BPA. It is my understanding that the Idaho Power Company does provide electrical service to customers located on the Fort Hall Indian Reservation at rates set by the Commission.
