On December 18,2017, the Commission received notice of a Petition for Declaratory
Order by Franklin Energy Storagc One through Four, LLC, challenging "ceftain orderc" of the
Commission before the Federal Energy Regulatory Commission (FERC). This Commission has
previously contracted with Attomey John Coyle, with Duncan & Allen, PLLC, to assist the
Commission in litigation before FERC because Mr. Coyle has expertise in matters before FERC.
The Comrnission does not have a current contract with Mr. Coyle.
COMMISSION DECISION
Does the Commission wish to conuact with Mr. Coyle to assist with pending FERC
litigation, and authorize the Commission's President to execute the conbact on the
Commission's behalf?,See Minute Order dated March 16, 2016 (delegating to the President the
ability to "[eJxecute contracts when authorized by the Commission").
