SUBJECT: RENEWING CONTRACT WITH JOHN COYLE TO ASSIST IN
LITIGATION
Last year, the Commission entered a contract with Attorney John Coyle of Duncan &
Allen, PLLC, under which Mr. Coyle agreed to serve as the Commission's counsel in Franklin
Energy One, et al. v. Kjellander, et c/. Docket No. I : l8-cv-00236-REB in the United States District
Court for the District of Idaho. [n February , 2019, the Court heard oral argument on the summary
judgment motions that had been filed in the case. The Court has not yet issued its decision, and we
have no indication as to when the decision might issue.
Mr. Coyle's contract is set to expire at the end of the fiscal year, June 30,2019, unless
it is renewed. Since the Franklin Energy litigation is still pending, Mr. Coyle has expressed his
willingness to renew his contract with the Commission for another year, or until his duties under
the contract have been completed, whichever is sooner.
COMMISSION DECISION
Does the Commission wish to authorize its President to execute an amendment that
would renew Mr. Coyle's contract for another year or until Mr. Coyle's duties under the contract
have been completed, whichever is sooner?
