HomeMy WebLinkAbout20220202Notice_of_Petition_Order_No_35307.pdfNOTICE OF PETITION NOTICE OF MODIFIED PROCEDURE ORDER NO. 35307 1 Office of the Secretary Service Date February 2, 2022 BEFORE THE IDAHO PUBLIC UTILITIES COMMISSION On January 4, 2022, Avista Corporation d/b/a Avista Utilities (“the Company”) petitioned the Idaho Public Utilities Commission (“Commission”) for a two-month extension to file its 2023 electric integrated resource plan (“IRP”)—such that it would be filed June 1, 2023, rather than April 1, 2023. The Commission now issues this Notice of Petition and Modified Procedure setting deadlines for interested persons to comment on the Petition and for the Company to reply. NOTICE OF PETITION YOU ARE HEREBY NOTIFIED that the Company is an electric corporation and public utility as defined in Idaho Code §§ 61-119 and 61-129 and is licensed to do business in the State of Idaho. YOU ARE FURTHER NOTIFIED that the IRP is a public process to identify and evaluate various energy resource options to meet future customer load requirements and indicate potential shortfalls. Company’s Petition at 2. The Company submits its electric IRP to the Commission every two years pursuant to Order No. 22299. Id. As such, the Company’s next IRP is required to be filed with the Commission on or before April 1, 2023. Id. YOU ARE FURTHER NOTIFIED that through the IRP, the Company solicits technical expertise and feedback through a series of Technical Advisory Committee (“TAC”) meetings. Id. YOU ARE FURTHER NOTIFIED that the Company uses All-Source Request for Proposals (“RFP”) to comply with Purchase of Resource (PoR) rules in Washington. AVU-E-22-01 NOTICE OF PETITION NOTICE OF MODIFIED PROCEDURE ORDER NO. 35307 NOTICE OF PETITION NOTICE OF MODIFIED PROCEDURE ORDER NO. 35307 2 480-107.1 The Company’s November 1, 2021, RFP draft is scheduled to be released in the first quarter of 2022 and is scheduled to be completed in the fourth quarter of 2022. Petition at 2-3. Because of this schedule, the Company is requesting a two-month extension to file its IRP with the Commission “in order to provide enough time for the conclusion of its 2022 [RFPs]. . . [which] enables any changes in resource acquisitions that may impact IRP modeling . . ..” Id. The Company states that without the completed RFP, the IRP modeling results would be premature and incomplete. Id. at 3. YOU ARE FURTHER NOTIFIED that the Company recently discussed the extension of its IRP filing date with its TAC, Stakeholders, and Staff—all of which supported the extension. Id. YOU ARE FURTHER NOTIFIED that the Petition is available for public inspection during regular business hours at the Commission’s office. These documents are also available on the Commission’s web site at www.puc.idaho.gov. Click on the “ELECTRIC” icon, select “Open Cases,” and click on the case number as shown on the front of this document. YOU ARE FURTHER NOTIFIED that all proceedings in this case will be held pursuant to the Commission’s jurisdiction under Title 61 of the Idaho Code. YOU ARE FURTHER NOTIFIED that all proceedings in this matter will be conducted pursuant to the Commission’s Rules of Procedure, IDAPA 31.01.01.000 et seq. NOTICE OF MODIFIED PROCEDURE YOU ARE FURTHER NOTIFIED that the Commission has determined that the public interest may not require a formal hearing in this matter and will proceed under Modified Procedure pursuant to Rules 201 through 204 of the Idaho Public Utilities Commission’s Rules of Procedure, IDAPA 31.01.01.201 through .204. The Commission notes that Modified Procedure and written comments have proven to be an effective means for obtaining public input and participation. YOU ARE FURTHER NOTIFIED that persons desiring to state a position on this Petition may file a written comment explaining why the person supports or opposes the Petition. Persons who would like a hearing must specifically request a hearing in their written comments. Persons must file written comments by February 24, 2022. YOU ARE FURTHER NOTIFIED that if no written comments or protests are received within the time limit set, the Commission will consider this matter on its merits and enter its order without a formal hearing. If written comments are received within the time limit set, the Commission will consider them and, in its discretion, may set the same for formal hearing. O R D E R IT IS HEREBY ORDERED that the Company’s Petition be processed by Modified Procedure, Rules 201-204 (IDAPA 31.01.01.201-.204). The Company must file any reply comments by March 3, 2022. IT IS FURTHER ORDERED that the parties should continue to comply with Order No. 35058, issued June 3, 2021. All pleadings should be filed with the Commission electronically and shall be deemed timely filed when received by the Commission Secretary. See Rule 14.02. Service between parties should also be accomplished electronically. Voluminous discovery-related documents may be filed and served on CD-ROM or a USB flash drive.
