I I. INTRODUCTION
Avista Corporation, doing business as Avista Utilities (hereinafter Avista or Company),
at 1411 East Mission Avenue, Spokane, Washington, respectfully requests that the
Commission approve the enclosed Aereement to Release Electric Service (Exhibit A) with
Kootenai Electric Cooperative (hereinafter referred to as Kootenai Electric) and Michael Lee
("Customer"), sometimes hereinafter referred to individually, as a "Party", and collectively, as
the "Parties".
The Parties have entered into an agreement pursuant to the Idaho Electric Supplier
Stabilization Act) "IESS", Idaho Code $$ 6l-332 et seq.
The Company requests that this filing be processed under the Commission's Modified
Procedure rules.

II. BACKGROUND
The Customer plans to build a new residential shop ("Shop") on his residential property
located at 3970 N Jonquil Ct. in Coeur D'Alene, Idaho (the "Property"). Avista's current
electric service is approximately 86 feet from the new service entrance for the Shop, and a line
extension to the Shop would require a permit to cross Williams Pipeline (which runs across
the Property). Currently, KEC has an electric service line and junction enclosure within 30 feet
of the proposed service entrance for the Shop, and has the ability to provide electric service to

the Shop. Allowing KEC to install the electrical distribution facilities and provide electric
service to the Shop will reduce the Customer's line extension costs and avoid the construction
delay associated with the permitting process.
Because it is in the best interest of all parties involved, Mr. Lee, Avista and KEC, Avista
agrees to release its rights to provide electric service to the Shop being constructed closer to
KEC's service point, and KEC agrees to install the facilities and provide electric service to the
Shop, subject to the terms of the Agreement herein provided as Attachment A.
WHEREFORE Avista respectfully requests the Commission approve the "Agreement
to Release Electric Customer". Avista believes that the Agreement is in the best of the
Customer; it will avoid duplication of facilities, avoid disputes between parties, and provides
the consumer with the best possible service.

Agreement to Release Electric Service
Avista Contract M-17 219
This Agreement to Release Electric Service ("Agreement") is entered into between Avista Corporation ("Avista")
and Kootenai Electric Cooperative, Inc. ("KEC"), sometimes referred to, individually, as a "Partyu and collectively,
as the "Parties".
Background and Purpose: Avista's electric customer, Michael Lee (or "Customer"), plans to build a new residential
shop ("Shop") on his residential property located at 3970 N Jonquil Ct. in Coeur d'Alene, ID (the
"Property"). Avista's current electric service is approximately 86' from the new service entrance for the Shop, and
a line extension to the Shop would require a permit to cross Williams Pipeline (which runs across the
Property). Currently, KEC has an electric service line and junction enclosure within 30' of the proposed service
entrance for the Shop and has the ability to provide electric service to the Shop. Allowing KEC to install the electrical
distribution facilities ("Facilities") and provide electric service to the Shop will reduce the Customer's line extension
costs and avoid the construction delay associated with the perrnitting process.
Because it is in the best interest of all parties involved, Mr. Lee, Avista and KEC, Avista agrees to release to KEC,
its rights to provide electric service to the Shop being constructed closer to KEC's service point, and KEC agrees to
install the Facilities and provide electric service to the Shop, subject to the terms of this Agreement. Therefore the
Parties agree as follows
1. Avista permanently releases to KEC, its right to provide electric service to Customer's Shop, only, which is being
constructed on the Property closest to KEC's service point at Fairway Forest 3'd Addition, Lot 18, Block 7.
2. KEC will install the Facilities to the Shop in accordance with its published Line Extension Policy and,
subsequently, provide electric service to the Shop.
3. KEC acknowledges that Avista will retain the electric service rights to the Customer's remaining Property.
4. Avista will prepare and submit the application for approval of this Agreement with the Commission, and KEC
shall join in or otherwise cooperate in the application; provided, however, that both Parties shall support this
allocation of electric service rights with their existing customers.
5. In the event the Commission does not approve Avista's release and associated electric service rights described in
this Agreement, then this Agreement will be void ab initio, and the Parties will renegotiate an agreement that is
ultimately acceptable to the Commission.
6. If approved by the Commission, this Agreement shall be binding upon the Parties, their successors and assigns.
