HomeMy WebLinkAbout20171108order_no_33931.pdfOffice of the Secretary Service Date November 8,2017 BEFORE THE IDAHO PUBLIC UTILITIES COMMISSION IN THE MATTER OF THE JOINT ) APPLICATION OF HYDRO ONE LIMITED )CASE NOS.AVU-E-17-09 AND AVISTA CORPORATION FOR )AVU-G-17-05 APPROVAL OF MERGER AGREEMENT ) )ORDER NO.33931 On October 26,2017,Washington and Northern Idaho District Council of Laborers (WNIDCL)moved the Idaho Public Utilities Commission (Commission),under Commission Rules of Procedure 19 and 43.03 and Idaho Bar Commission Rule (IBCR)227,for an Order approving the limited admission,pro hac vice,of Danielle Franco-Malone in this matter.The Motion was signed and attested to by local counsel James Piotrowski of Boise,Idaho (Idaho State Bar License No.5911). In the Motion,Ms.Franco-Malone certifies that she is an active member in good standing of the Washington State Bar who maintains the regular practice of law in Washington. She further declares that she is not an Idaho resident or licensed to practice law in Idaho. Ms.Franco-Malone and Mr.Piotrowski certify that a copy of the Motion has been served on all other parties to this case,and that a copy of the Motion,accompanied by a $325 fee and a certificate of good standing,have been submitted to the Idaho State Bar.Mr.Piotrowski acknowledges that his attendance shall be required at all Commission proceedings in which Ms. Franco-Malone appears,unless specifically excused by the Commission. COMMISSION FINDINGS The Commission has reviewed and considered the Motion and applicable rules, including IBCR 227 and Commission Rules of Procedure 19 and 43.03,IDAPA 31.01.01.019 and 043.03.Based on the filings of record and certified representations of Ms.Franco-Malone and Mr.Piotrowski,we find that reasonable grounds have been demonstrated to justify the granting of limited admission of Ms.Franco-Malone as legal counsel for Washington and Northern Idaho District Council of Laborers.We further find good reason to excuse the appearance of Mr.Piotrowski in further proceedings in this docket unless needed by Ms.Franco- Malone. CONCLUSIONS OF LAW The Commission has jurisdiction in this case and over this Motion pursuant to Idaho Code,Title 61,and the Commission's Rules of Procedure,31.01.01.000et seq. ORDER NO.33931 1 ORDER IT IS HEREBY ORDERED that the Motion is granted;Danielle Franco-Malone is hereby granted limited admission as legal counsel for Washington and Northern Idaho District Council of Laborers. IT IS FURTHER ORDERED that the attendance of James Piotrowski is excused from all further proceedings in Case Nos.AVU-E-17-09 and AVU-G-17-05 unless needed by Danielle Franco-Malone.
