HomeMy WebLinkAbout20170929order_no_33890.pdfOffice of the Secretary Service Date September 29,2017 BEFORE THE IDAHO PUBLIC UTILITIES COMMISSION IN THE MATTER OF THE JOINT ) APPLICATION OF HYDRO ONE LIMITED )CASE NOS.AVUE-17-O9 AND AVISTA CORPORATION FOR )AVU-G-17-05 APPROVAL OF MERGER AGREEMENT ) ________________________________ )ORDER NO.33890 On September 18,2017,Hydro One Limited moved the Idaho Public Utilities Commission (Commission),under Commission Rules of Procedure 19 and 43.03 and Idaho Bar Commission Rule (IBCR)227,for an Order approving the limited admission,pro hac vice,of Elizabeth Thomas and Kari Vander Stoep in this matter.The Motion was signed and attested to by local counsel Teresa A.Hill of Boise,Idaho (Idaho State Bar License No.6175). In the Motion,Ms.Thomas certifies that she is an active member in good standing of the Washington State Bar who maintains the regular practice of law in Washington.She further declares that she is not an Idaho resident or licensed to practice law in Idaho. In the Motion,Ms.Vander Stoep certifies that she is an active member in good standing of the Washington and Montana State Bars who maintains the regular practice of law in Washington.She further declares that she is not an Idaho resident or licensed to practice law in Idaho. Ms.Hill,Ms.Thomas and Ms.Vander Stoep certify that a copy of the Motion has been served on all other parties to this case,and that a copy of the Motion,accompanied by a $325 fee (per applicant)and certificates of good standing,have been submitted to the Idaho State Bar.Ms.Hill acknowledges that her attendance shall be required at all Commission proceedings in which Ms.Thomas or Ms.Vander Stoep appear,unless specifically excused by the Commission. COMMISSION FINDINGS The Commission has reviewed and considered the Motion and applicable rules, including IBCR 227 and Commission Rules of Procedure 19 and 43.03,IDAPA 31.01.01.019 and 043.03.Based on the filings of record and certified representations of Ms.Hill,Ms.Thomas and Ms.Vander Stoep,we find that reasonable grounds have been demonstrated to justify the granting of limited admission of Ms.Thomas and Ms.Vander Stoep as legal counsel for Hydro One Limited.We further find good reason to excuse the appearance of Ms.Hill in further proceedings in this docket unless needed by Ms.Thomas or Ms.Vander Stoep. ORDER NO.33890 1 CONCLUSIONS OF LAW The Commission has jurisdiction in this case and over this Motion pursuant to Idaho Code,Title 61,and the Commission’s Rules of Procedure,3l.0L0lOO0 etseq. ORDER IT IS HEREBY ORDERED that the Motion is granted;Elizabeth Thomas and Kari Vander Stoep are hereby granted limited admission as legal counsel for Hydro One Limited. IT IS FURTHER ORDERED that the attendance of Teresa A.Hill is excused from all further proceedings in Case Nos.AVU-E-17-09 and AVU-G-17-05 unless needed by Elizabeth Thomas or Kari Vander Stoep.
