YOU ARE HEREBY NOTIFIED that on February 2, 2009, Avista Corporation
A vista" or "Company ) filed an Application with the Commission seeking approval of its
Electric Distribution Service Agreement ("Agreement") with East Greenacres Irrigation District
East Greenacres
YOU ARE FURTHER NOTIFIED that the parties entered into the Agreement on
January 30, 2009 and have stipulated to an effective date of March 1 , 2009 or the first day
following an Order by the Commission granting approval of the Agreement. The Agreement
does not contain a fixed termination date
YOU ARE FURTHER NOTIFIED that the Agreement provides for the continued
delivery of United States Bureau of Reclamation energy over A vista-owned and -operated
distribution facilities from Avista s Post Falls Substation to certain delivery points on the East
Greenacres system.
YOU ARE FURTHER NOTIFIED that Avista states in its Application that the
distribution rate charged by the Company is "consistent with distribution charges embedded in
current Idaho retail rates" and the net revenues generated via the Agreement will serve as an
offset to the Company s fixed costs.
YOU ARE FURTHER NOTIFIED that the distribution charge recited in the
Agreement is $3 622.77 per month, or $43 473.24 per year.

YOU ARE FURTHER NOTIFIED that the Commission has determined that the
public interest may not require a formal hearing in this matter and will proceed under Modified
Procedure pursuant to Rules 201 through 204 of the Idaho Public Utilities Commission s Rules
of Procedure IDAPA 31.01.01.201 through .204.The Commission notes that Modified
Procedure and written comments have proven to be an effective means for obtaining public input
and participation.
YOU ARE FURTHER NOTIFIED that any person desiring to state a position on this
Application may file a written comment in support or opposition with the Commission within
twenty-one (21) days from the service date of this Notice. The comment must contain a
statement of reasons supporting the comment. Persons desiring a hearing must specifically
request a hearing in their written comments. Written comments concerning this Application
shall be mailed to the Commission and the Applicant at the addresses reflected below:

hearing.

YOU ARE FURTHER NOTIFIED that the Application has been filed with the
Commission and is available for public inspection during regular business hours at the
Commission offices. The Application is also available on the Commission s Web site at
www.puc.idaho.gov and then clicking on the "File Room" and then the "Electric Cases.
YOU ARE FURTHER NOTIFIED that all proceedings in this case will be held
pursuant to the Commission s jurisdiction under Title 61 of the Idaho Code and specifically
Idaho Code ~~ 61.,524. The Commission may enter any final Order consistent with its authority
under Title 61.
YOU ARE FURTHER NOTIFIED that all proceedings in this matter will be
conducted pursuant to the Commission s Rules of Procedure, IDAPA 31.01.01.000 et seq.

IT IS HEREBY ORDERED that this Application will be processed under Modified
Procedure. Persons interested in submitting written comments regarding this case or protesting
the use of Modified Procedure should do so no later than 21 days from the service date of this
Order.
