A VU-05- 7 COMPLAINANT NOTICE OF HEARING VISTA CORPORATION dba A VISTA UTILITIES, a Washington Corporation, RESPONDENT. On August 30, 2005 , Thompson River Co-Gen, LLC (Thompson River; TRC) filed a Complaint against Avista Corporation dba Avista Utilities (Avista; Company) with the Idaho Public Utilities Commission (Commission). TRC is a cogeneration facility located in Thompson Falls, Montana. TRC represents that it is a self-certified qualifying facility (QF) as defined by the Public Utility Regulatory Policies Act of 1978 (PURPA). TRC requests an order requiring Avista to immediately complete the purchase of TRC's energy at the published non-Ievelized rate for fueled projects that under normal and average design conditions generate no more than 10 aMW in any given month. On October 5 (18), 2005, Avista filed an Answer (Amended Answer) with the Commission requesting a dismissal of the TRC Complaint. Pursuant to agreement of the parties and the Commission YOU ARE HEREBY NOTIFIED that the following scheduling has been adopted in Case No. A VU-05- 7: December 21 , 2005 Deadline for A vista follow-up discovery to TRC January 6, 2006 TRC discovery response deadline YOU ARE FURTHER NOTIFIED that a settlement conference in Case No. A VU- 05-7 is scheduled for TUESDAY. JANUARY 24. 2006 COMMENCING AT 9:30 A.M. AT THE COMMISSION HEARING ROOM. 472 WEST WASHINGTON STREET. BOISE. IDAHO 83702. NOTICE OF SCHEDULING NOTICE OF HEARING YOU ARE FURTHER NOTIFIED that on December 5 , 2005, Thompson River Co- Gen, LLC filed a Motion to Strike portions of Avista Corporation s amended Answer. Pursuant to agreement of the parties, YOU ARE HEREBY NOTIFIED that the deadline for Avista Answer to TRC's Motion to Strike is Tuesday, January 31, 2006. YOU ARE FURTHER NOTIFIED that on November 10, 2005, TRC filed direct testimony and exhibits in Case No. AVU-05-7. Pursuant to agreement of the parties the following schedule is adopted for further prefile of testimony: February 20, 2006 A vista prefile direct testimony and exhibits March 10, 2006 Commission Staff prefile direct testimony and exhibits March 10 2006 Pacifi Corp/ A vista prefile rebuttal and exhibits YOU ARE FURTHER NOTIFIED that all testimony and exhibits in Case No. A VU- 05-7 must comport with the requirements of Rule 231 of the Commission s Rules of Procedure, IDAPA 31.01.01.231. YOU ARE FURTHER NOTIFIED that discovery is available pursuant to the Commission s Rules of Procedure, IDAPA 31.01.01.221-234. YOU ARE FURTHER NOTIFIED that pursuant to agreement of the parties and the Commission, a technical hearing in Case No. A VU-05- 7 is scheduled to commence on TUESDAY. MARCH 28. 2006 AT 9:30 A.M. AT THE COMMISSION'S HEARING ROOM. 472 WEST WASHINGTON STREET. BOISE. IDAHO and continue if necessary on Wednesday, March 29, 2006. YOU ARE FURTHER NOTIFIED that the Commission has jurisdiction over Avista Corporation dba Avista Utilities, an electric utility, pursuant to the authority and power granted it under Title 61 of the Idaho Code and the Public Utility Regulatory Policies Act of 1978 (PURPA). The Commission has the authority under PURP A and the implementing regulations of the Federal Energy Regulatory Commission (FERC) to set avoided costs, to order electric utilities to enter into fixed term obligations for the purchase of energy from qualified facilities and to implement FERC rules. YOU ARE FURTHER NOTIFIED that all proceedings in this matter will be conducted according to the Commission s Rules of Procedure, IDAPA 31.01.01.000 et seq. NOTICE OF SCHEDULING NOTICE OF HEARING YOU ARE FURTHER NOTIFIED that all hearings and settlement conferences in this matter will be held in facilities meeting the accessibility requirements of the Americans with Disabilities Act (ADA).
