Avista Corporation ("Avista ) herby gives notice that it is filing a Second Amended
Answer, which is filed herewith. The Second Amended Answer deletes A vista s original Third
Affirmative Defense and Fifth Affirmative Defense, which are the subject of Thompson River
Co-Gen s motion to strike, and renumbers the remaining affirmatives defenses so that they are
consecutive. Accordingly, the motion to strike is moot, and no further response is required at
this time.
