Re: Case No. AVU-E-01-2
Service Terrtory Agreement between Avista Utilities and Kootenai Electrc Cooperative, Inc.
Dear Ms. Jewell:
In Order 28621 in Docket A VU-E-01-2, the Commission approved the Service Terrtory Agreement
(Agreement) between Avista Utilities and Kootenai Electrc Cooperative, dated Februar 15, 1991.
The Commission furter ordered that "the agreement shall continue in force until Februar 15, 2011".
Pursuant to the ters and conditions outlined in the approved Agreement, at Page 3, "(t)he duration of
this agreement shall be extended automatically for successive periods often (10) years upon the same
terms and conditions set forth in this agreement, unless one of the paries notifies the other, not less
than sixty (60) days before the end of the initial, or renewal, term of the intent not to renew the
agreement".
Neither Avista Utilties nor Kootenai Electrc notified each other regarding their intent not to renew the
Agreement. As such, the Agreement is now in force until Februar 15, 2021, per the ters and
conditions noted above.
