Of!lce of the Secretary Service Date JUN 2 - 1987 BEFORE THE IDAHO PUBLIC UTILITIES COMMISSION IN THE MATTER OF THE APPLICATION OF THE ATLANTA POWER COMPANY FOR)APPROVAL OF A MORE SPECIFIC CERTIFICATE OF PUBLIC CONVENIENCEAND NECESSITY CASE NO. U-1147- ORDER NO. 21261 On January 5, 1987, the Atlanta Power Company (Atlanta; Company) filed an Applicati~m with the Idaho Public Utilities Commission (Commission) seeking to demarcate, in metes and bounds, the extent of its certificated service area. (reference Certificate No. 300) On December 6 , 1985, Atlanta filed an application to be granted a Certificate of Public Convenience and Necessity for an area of approximately 600 square miles in South Central Idaho. The Company s request included parts of Boise, Camas, Blaine and Elmore Counties. - Prairie Power Cooperative objected.Prairie questioned whether Atlanta had the resources to serve the vast and geographically rugged territory it was attempting to carve out for itself. We refused to rule on Atlanta s application at that time. We said in Order No. 20327: Because Atlanta is committed to filing a general rate case on March, 1986, we deny Prairie s request for an immediate hearing on theissue of Atlanta s proposed certificated area. Rather, we herebycertificate to Atlanta Power Company only that territory it actually currently serving and no more. We hold in abeyance,pending the filing of Atlanta s March 1 , 1986 rate case, the questionof the remainder of the requested service area. Prairie Power ishereby notified that the question of Atlanta s requested certificatedarea will be addressed in Atlanta s March 1 , 1986 rate case. As a result, we issued Certificate of Public Convenience and Necessity No. 300 to the Atlanta Power Company. That Certificate provided that Atlanta may serve only: that certain territory within and surrounding the community ofAtlanta, Idaho that it is serving as of the date of this Certificate(January 23, 1986). ORDER No. 21261 Atlanta s March 1986, rate filing did not mention the Company s previous application for a certificate to serve the large section of South Central Idaho initially requested. However , on March 11 , 1986, the Company filed a separate application requesting that its Certificate of Public Convenience and Necessity be expanded to include the area denied in Order No. 20237. By Order No. 20367 , we also denied the Company s Applicationfor an expanded service area: We are left in the same posture referred to in Order No.20237--Atlanta . Power has not provided sufficient data to supportits application. Because we have no information on which to base adecision, we deny Atlanta s request to expand its territory. WhenAtlanta files an Application with sufficient supporting data, we willof course consider its request. On March 13, 1987 , the Commission issued Order No. 21110 inviting comment or protest concerning the proposed delineation of Atlanta Power s certificated area. A letter of protest was filed on March 18, 1987 by Atlanta residents objecting to the proposed "expansion of borders" by Atlanta Power. The protesters, comprised of a mix of utility customers and non-customers, expressed concern regarding the present quality of service and safety standards and the capacity of the system to meet additional demand. The Company in a letter of response dated May 26, 1987, relates that it is engaged in "an ongoing program to improve the status and operation of the system" and is providing power to anyone who wants it and is willing to pay for it." The Company stresses the need for building customer base as a means for improving the viability of the utility and the quality of its service. We encourage the Company in its efforts. For reasons stated below the Commission does not view the Company s filiRg as an Application for "expansion of borders.It is merely a demarcation with more specificity of its presently authorized service territory.We continue to hold the ORDER No. 21261 Company to its commitment to provide transmission and distribution facilities in . compliance with National Electric Safety Code standards. We trust that the improvement of system safety will translate to improvements in service and reliability. But , as we stated in Order No. 20785, "at this point in the evolution of the Atlanta Power Company . the primary objective of all concerned must be a safe system-investments made solely in the name of improving the quality of service must, of necessity, take a secondary role to safety." We appreciate the concerns raised by Atlanta customers over system safety. share in those concerns and trust in the Company s commitment to safety. We remind the customers of Atlanta, however, that system safety also extends to the electrical hazards presented by defective and substandard inside wiring. We encourage them to be ever vigilant and to report perceived system dangers to the utility and to this Commission. The Commission is sensitive to the potential impact of a new and major mining operation on system 10ad. It is unreasonable to expect the current customer base to absorb and assume responsibility for the increased costs attendant to the construction of new generating plant to meet new and exponentially greater demands on system load especially a demand that is tied to such vagaries as the market price of precious metals. For that reason we will expect such mining operation to provide its own power or to provide the utility with the contribution and advance of construction funds needed for the required changes and addition to generating plant to meet its demand. The current Application requests an area to be included in Atlanta s Certificate of Convenience and Necessity that includes just the townsite of Atlanta and its immediate environs. We find that the proposed demarcation is simply a definition, in ORDER No. 21261 cartographic terms, of the territory we contemplated in its approved Certificate of Convenience and Necessity No. 300. We further find that it is fair just and reasonable to grant the Company s application to specifically delimit its certificated area in the following manner: Begin at NW Corner Section 19, Township 6 North, Range 11 E.thence eastward to NE corner of Section 22; thence southward toNE corner Section 34; thence eastward to NE corner Section 31Township 6 N, Range 12 E.; thence southwaTd to SE cornerSection 19, Township 5 N, Range 12 E.; thence westward to . corner Section 24, Township 5 N , Range 10 E.B.M.; thencenorthward to NW corner Section 1; thence eastward to SW cornerSection 31 , Township 6 N, Range 11 E.B.M.; thence northward to NWcorner Section 19 , Township 6 N, Range 11 E.B.M., the POINT OFBEGINNING Attached to this Order is a map showing both the area initially requested by Atlanta in its previous applications and the area requested by the Company that we grant in this proceeding. IT IS THEREFORE ORDERED that the Application of the Atlanta Power Company in Case No. 1147-5 be approved as an addendum to Certificate of Public Convenience and Necessity No. 300 delimiting, in metes and bounds its certificated service area. THIS IS A FINAL ORDER. Any person interested in this Order (or in issues finally decided by this Order) or in interlocutory Orders previously issued in this Case No. 1147-5 may petition for reconsideration within twenty-one (21) days of the service date of this Order with regard to any matter decided in this Order or in interlocutory Orders previously issued in this Case No. U-1147-5. Within seven (7) days after any person has petitioned for reconsideration, any other person may cross-petition for reconsideration. See Idaho Code ~61-626.
