There was no footnote in the order to remind AP that rates should be adjusted upon satisfaction of the note to
IDWR Tr. pp. 152 , 153.
Our understanding is that the note to DWR for $57 000 for installation of a hydraulic gate on top of the dam has
now been paid off.
Has the 4.5 cents/kwh surcharge been removed? We do not see evidence that it has.
Furthermore , it is our understanding from reading PUC rules and regulations that , without a rate case , the above
surcharge should not have become a permanent part of the rates for AP customers.
Therefore , it is our position that , if this surcharge has not been removed , overpayments due to the surcharge
should be returned to AP customers for the period of time that began after the loan was paid off.
