IPC-E-23-21. On September 11, 2023, Idaho Power Company (“Company”) applied to the Idaho Public Utilities Commission (“Commission”) for a Commission order approving two amendments for two separate but related agreements—with each agreement being amended one time. The Company explained that the two original agreements were reached in 1979 (collectively “the 1979 Agreements”) between itself and the King Hill Irrigation District (“KHID”). The Company stated that the 1979 Agreements allow for the Company’s use of KHID’s water to generate 22,108 megawatt hours of power under median water conditions. See Order No. 14439. Both proposed amendments are related to the use of pumping stations to accomplish this aim. The Company requested this case be processed by Modified Procedure. STAFF RECOMMENDATION Staff recommended the Commission issue a Notice of Application and Notice of Modified Procedure establishing a public comment deadline of October 26, 2023, and a Company reply deadline of November 2, 2023. COMMISSION DECISION Does the Commission wish to issue a Notice of Application and Notice of Modified Procedure with public comments due by October 26, 2023, and Company reply comments due by November 2, 2023?
