HomeMy WebLinkAbout20230815_Rulemaking_sg.pdfDECISION MEMORANDUM TO: FROM: DATE: SUBJECT: COMMISSIONER ANDERSON COMMISSIONER LODGE COMMISSIONER HAMMOND COMMISSION SECRETARY COMMISSION STAFF LEGAL STEPHEN GOODSON, POLICY ADVISOR AUGUST 15, 2023 ZERO BASED RULES REVIEW - 2023 BACKGROUND Executive Order 2020-01, signed by Governor Little sets forth a Zero-Based Rule Review for all state agencies. A master schedule was created for agencies with specific sets of IDAP A rules to be reviewed over a five-year period. The Governor's Executive Order states that: ''DFM shall ensure the volume o_f'rules that are reviewed by the agencies in any given year is such that the public can engage and provide meaningful input in any individual rulemaking, with approximately twenty percent (20-percent) of rule chapters su�ject to review each year ... " This year's rules for review are IDAP A: ■ 31.12.01 -Systems of Accounting Rules ■ 31.21.01 -Customer Relations Rules ■ 31.26.01 -Master Metering Rules ■ 31.31.01 -Gas Services Rules Staff Conducted Negotiated Rule Making in July. Attached to this memo is the summary of the Negotiated Rulemaking. The Commission can now submit rule changes as Proposed Rules, to be published in the Administrative Bulletin. STAFF RECOMMENDATIONS Staff recommends the Commission direct Staff to submit the necessary forms to publish a Notice of Proposed Rulemaking in the Administrative Bulletin. COMMISSION DECISION Does the Commission wish to approve Staffs recommendations? Anything else?
