COMMISSION STAFF
LEGAL
FROM: DAYN HARDIE
DEPUTY ATTORNEY GENERAL
DATE: JANUARY 3, 2023
SUBJECT: IN THE MATTER OF ROCKY MOUNTAIN POWER’S APPLICATION
FOR A PRUDENCY DETERMINATION ON DEMAND SIDE
MANAGEMENT EXPENDITURES; CASE NO. PAC-E-22-12.
On August 17, 2022, Rocky Mountain Power, a division of PacifiCorp, requested an
order designating $10,039,507 in expenditures on demand side management incurred in 2020 and
2021 as prudent.
On September 14, 2022, the Commission issued a Notice of Application and set an
intervention deadline for interested parties. Order No. 35530. No parties petitioned to intervene.
On November 4, 2022, the Commission issued a Notice of Modified Procedure setting
a January 12, 2023 public comment deadline and a January 26, 2023 Company reply deadline.
Order No. 35584.
Staff has propounded several discovery requests upon the Company, some that Staff
did not feel were adequately responded to. Staff is working with the Company to make sure it
receives sufficiently detailed responses so it can make an informed recommendation to the
Commission. To allow more time to attain the information it seeks, Staff proposes to vacate the
public comment and Company reply deadlines established in Order No. 35584 and establish new
comment deadlines that will allow all parties additional time to file comments. The Company
supports extending the comment deadlines.
DECISION MEMORANDUM 2
STAFF RECOMMENDATION
Staff recommends the Commission issue a Notice of Amended Comment Deadlines
vacating the existing comment deadlines and establishing a February 23, 2023 public comment
deadline and a March 9, 2023 Company reply deadline.
COMMISSION DECISION
Does the Commission wish to issue a Notice of Amended Comment Deadlines vacating
the existing comment deadlines and establishing a February 23, 2023 public comment deadline
and a March 9, 2023 Company reply deadline?
