SUBJECT: UPDATING LIST OF REGULATED UTILITIES FOR ASSESSMENT
The Commission has authority to administratively remove utilities and railroads from the
list of utilities subject to the annual regulatory fee. See IDAPA 31.01.01.018.02 (Rule 18). A
utility or railroad may be removed from the list if they: ( 1) fail to pay their special regulatory
fees; (2) are no longer conducting business in Idaho; and (3) fail to maintain a designated agent
for service with Commission Secretary. Id.
Fiscal staff has reviewed the list of utilities and railroads subject to the annual regulatory
fee and have identified seven Title 62, Interexchange carrier, and payphone telecommunication
companies that meet the criteria of Rule 18 but have failed to pay their regulated fees 2022. The
cumulative outstanding balance for all seven companies totals $662.24 as of December 8, 2022.
The attached list of telecommunication carriers by company name, reflect the Secretary of State
Certificate number (if one exists), and the status of the company's certificate, see Attachment 1.
As evidenced in Attachment 1, each telecommunications utility listed meets the three conditions
to be administratively removed from the list of utilities subject to the annual regulatory fee.
STAFF RECOMMENDATION
Based on the upcoming assessment period, and because these companies should be
removed from the list of Idaho utilities for the reasons stated above, staff recommends that the
Commission approve for administrative removal of these seven utilities from the assessment list.
