HomeMy WebLinkAbout20221129_PACE2218_md.pdf DECISION MEMORANDUM 1 DECISION MEMORANDUM TO: COMMISSIONER ANDERSON COMMISSIONER CHATBURN COMMISSIONER HAMMOND COMMISSION SECRETARY COMMISSION STAFF LEGAL FROM: MICHAEL DUVAL DEPUTY ATTORNEY GENERAL DATE: NOVEMBER 29, 2022 SUBJECT: IN THE MATTER OF PACIFICORP’S APPLICATION FOR APPROVAL OR REJECTION OF THE POWER PURCHASE AGREEMENT WITH OJA, LLC; CASE NO. PAC-E-22-18. On November 14, 2022, Rocky Mountain Power, a division of PacifiCorp (“Company”) applied to the Commission for approval or rejection of a Power Purchase Agreement (“PPA”) between the Company and Larry and Christie Oja (“Sellers”) for energy produced by Sellers’ 288-kilowatt (“kW”) small-hydro facility (“Facility”) located in Oneida County, Idaho. The Facility is a qualifying facility (“QF”) under the Public Utility Regulatory Policies Act of 1978 (“PURPA”). If the PPA is approved, the Company requests that the Commission order also “[d]eclare that the avoided cost prices set forth in the contract are just and reasonable, in the public interest, and that the Company’s incurrence of such costs are legitimate expenses for recovery in rates in the state of Idaho.” The Company also requests that its Application be processed by modified procedure. STAFF RECOMMENDATION Staff recommends the Commission issue a Notice of Application and Notice of Modified Procedure establishing a January 4, 2023, public comment deadline and a January 11, 2023, Company and Seller reply deadline.
