RE: CALCULATING THE 2010 REGULATORY FEE ASSESSMENTS FOR
PUBLIC UTILITIES AND RAILROADS, CASE NOS. F-2010-1 AND F-2010-2
In April 2010, the Legislature passed Senate Bil 1388 appropriating $5,142,600 to
the Commission for Fiscal Year 2011 operations. The total appropriation consists of $141,500
from fees assessed on railroad corporations; $4,679,200 from fees assessed on public utilities;
$101,700 expenditures for pipeline safety activities reimbursable by the federal governent; and
$220,200 expenditUes"for American Reinvestment & Recovery Act activities reimbursed by the
federal governent. Attachment 1 shows the calculations to arrive at the budget amounts.
Attachment 2 shows the calculations to arive at the assessment rates for utilities and railroads,
respectively.
1. Utility Assessment. The utilties have an adjusted cary-over balance of $414,407
from Fiscal Year 2009 expenditures. Thus, the Staff calculates that the 2010 assessment for
public utilities to fund Fiscal Year 2011 is $4,264,792.
For calendar year 2009, Title 61 and Title 62 utilities reported gross intrastate
operating revenues from utility operations in Idaho totaling $2,092,041,093. This is a reported
revenue increase of $13,139,294 from the prior year, or a .63% increase. Accordingly, the Staff
determined the proportionate share of each utility's fee should be assessed at .2039% (.002039)
of each utilty's gross intrastate operating revenue. Pursuant to Idaho Code § 61-1004(3) the
minimum regulatory fee assessed is $50.
DECISION MEMORANDUM
2. Railroad Assessment. Estimated railroad expenditures for FY 20 i i are $ i 4 1,500.
Staff recommends a one-time fund adjustment of ($6,700). Thus, the proportionate share of the
assessment is $134,800. The gross intrastate operating revenue from railroad operations in Idaho
was $13,774,935 for calendar year 2009. This is a decrease of $3,405,944, down 19.82% from
the prior year. Accordingly, the proportionate share of each railroad's fee is to be assessed at
.9786% (.009786) of each railroad's gross intrastate operating revenues. No railroad shall be
assessed less than $50, Idaho Code § 61-1004(3).
