COMMISIONER HAMMOND
COMMISSION SECRETARY
COMMISSION STAFF
FROM: STEPHEN GOODSON
DATE: March 29, 2022
SUBJECT: ZERO BASED RULE REVIEW
Executive Order 2020-01, signed by Governor Little set forth a zero-based rule review for
all state agencies. A master schedule was created for agencies with specific sets of IDAPA rules to
be reviewed over a five-year period
“to determine whether the benefits the rule intended to achieve are being realized, whether those
benefits justify the costs of the rule, and whether there are less restrictive alternatives to accomplish
the benefits.”
This year’s IDAPA rules for review are IDAPA 31.3.16.101 Stray Voltage and 31.3.18.101
Energy Consumption Reporting. Commission Staff will engage all stakeholders in a negotiated rule
making process over the upcoming summer months.
The deadline to submit a Notice of Intent to the Division of Financial Management to be
published in the Administrative Bulletin is Friday, April 1, 2022. Staff recommends that the
Commission direct for the submission of a Notice of Intent to the Division of Financial
Management to be published in the Administrative Bulletin.
COMMISSION DECISION
Does the Commission agree with Staff’s recommendation to submit a Notice of Intent to
initiate rule review to the Division of Financial Management by Friday, April 1, 2022?
