NOTICE OF PROPOSED OMNIBUS RULEMAKING- IDAPA 31.01.01
BACKGROUND
By statute, rules promulgated by state agencies under the Idaho Administrative Procedures Act expire on July 1st of each year unless the Legislature extends the rules by statute. J.C. § 67-5292. The Legislature adjourned/recessed its session this year without passing a bill to reauthorize agency rules for the next year. On May 28, 2021 the Commission voted to adopt their rules as
temporary.
As of July 1 st all Idaho administrative rule chapters are effective as temporary rules. The Governor has directed DFM to work with all state executive agencies to take necessary rules
from temporary to proposed, and later pending, and submit them for 2022 legislative review as an omnibus rulemaking.
STAFF RECOMMENDATIONS
Staff recommends the Commission direct Staff to submit the necessary forms to publish a Notice of Proposed Omnibus Rulemaking in the Administrative Bulletin.
