HomeMy WebLinkAbout20200922_mh1.pdfDECISION MEMORANDUM 1 I:\Legal\CONTRACTS\One Call Grant -DBS agrt\2020 grant\Approval of Inter-Agency Agreement_dec_memo_mh.docx DECISION MEMORANDUM TO: COMMISSIONER KJELLANDER COMMISSIONER RAPER COMMISSIONER ANDERSON COMMISSION SECRETARY COMMISSION STAFF LEGAL FROM: MATT HUNTER DEPUTY ATTORNEY GENERAL DATE: SEPTEMBER 18 , 20 20 SUBJECT: COMMISSION AND DBS AGREEMENT ON THE ONE-CALL GRANT The Commission is Idaho ’s only agency that can apply for the U.S. Department of Transportation, Pipeline and Hazardous Materials Safety Administration’s (PHMSA’s) One -Call Grant (Grant). The Grant help s states support and improve pipeline safety . State s may use it for damage prevention, improv ing underground damage prevention laws, and related activities. For several years, the Commission has applied for and obtained the Grant on the Idaho Division of Building Safety ’s (DBS’s) behalf . After obtaining the Grant, the Commission signs an inter- agency agreement with DBS for the transfer and management of the Grant money. On August 18, 2020, PHMSA awarded the Commission a new Grant with a September 30, 2020 through September 29, 202 1 term, and Commission Staff negotiated an other inter-agency agreement with DBS (Agreement). The new Agreement would require the Commission to reimburse DBS for documented Grant expenses. The Commission must comply with the Grant requirements. Both the Commission and DBS must keep accurate and complete records for auditing purposes. DBS has signed the Agreement. STAFF RECOMMENDATION Staff recommends the Commission approve the Agreement to help promote pipeline safety and enable Staff to efficiently and prudently manage the Grant money .
