HomeMy WebLinkAbout20200707_mh1.pdfDECISION MEMORANDUM 1 DECISION MEMORANDUM TO: COMMISSIONER KJELLANDER COMMISSIONER RAPER COMMISSIONER ANDERSON COMMISSION SECRETARY COMMISSION STAFF LEGAL FROM: MATT HUNTER DEPUTY ATTORNEY GENERAL DATE: JULY 2, 2020 SUBJECT: QWEST CORPORATION DBA CENTURYLINK QC’S TARIFF FILING, DISCONTINUING PRORATING OF CLOSING BILLS FOR RESIDENTIAL CUSTOMERS. On July 1, 2020, Qwest Corporation dba CenturyLink QC (“CenturyLink”) filed an updated tariff with the Commission as required by Idaho Code § 62-606. Notably, new language in the proposed tariff states that “[f]inal bills rendered after customer-requested discontinuance of residential service will not be [prorated] and service will remain available to the customer until the first day of the customer’s next billing cycle.” Proposed Tariff at 27. Currently, CenturyLink prorates a residential customer’s closing bill. STAFF RECOMMENDATION Staff believes all basic local exchange service providers in Idaho currently prorate the closing bill of a residential customer. Staff also believes the Commission has historically required basic local exchange providers to prorate residential customers’ closing bills. The Commission has “continuing authority to determine the noneconomic regulatory requirements relating to basic local exchange service for all telephone corporations providing basic local exchange service…” Idaho Code § 62-605(5)(b). Staff believes CenturyLink’s proposed tariff might be contrary to the Commission’s regulatory requirements. Therefore, Staff recommends the Commission suspend the proposed tariff’s effective date for 60 days, and initiate a formal proceeding to determine whether the proposed tariff complies with the Commission’s regulatory requirements. Staff also recommends the case be DECISION MEMORANDUM 2 processed by Modified Procedure, with an August 3, 2020 comment deadline and an August 10, 2020 reply comment deadline. COMMISSION DECISION Does the Commission wish to: 1. Initiate a formal proceeding to determine whether CenturyLink’s proposed tariff complies with the Commission’s regulatory requirements? 2. Process the case by Modified Procedure, setting an August 3, 2020 comment deadline and an August 10, 2020 reply comment deadline? 3.
