SUBJECT: NEW CONTRACT WITH JOHN COYLE TO ASSIST IN LITIGATION.
In January 2018, the Commission entered a contract with Attorney John Coyle of
Duncan & Allen, PLLC, under which Mr. Coyle agreed to serve as the Commission’s counsel in
matters related to Franklin Energy One, et al. v. Kjellander, et al., Docket No. 1:18-cv-00236-
REB in the United States District Court for the District of Idaho, which is now on appeal in the
United States Court of Appeals for the Ninth Circuit, Docket No. 20-35146.
Mr. Coyle’s contract is set to expire at the end of the fiscal year, June 30, 2020. The
Franklin Energy litigation/appeal is still pending.
COMMISSION DECISION
Does the Commission wish to authorize its President to execute a new contract with
Mr. Coyle on substantially similar terms as the last contract?
