HomeMy WebLinkAbout20200630_ej1.pdfDECISION MEMORANDUM 1 DECISION MEMORANDUM TO: COMMISSIONER KJELLANDER COMMISSIONER RAPER COMMISSIONER ANDERSON COMMISSION SECRETARY COMMISSION STAFF LEGAL FROM: EDWARD JEWELL DEPUTY ATTORNEY GENERAL DATE: JUNE 26, 2020 SUBJECT: IN THE MATTER OF THE APPLICATION FOR APPROVAL OF TIIE POWER PURCHASE AGREEMENT BETWEEN PACIFICORP AND COMMERCIAL ENERGY MANAGEMENT, INC.; CASE NO. PAC-E-20- 09. On June 8, 2020, Rocky Mountain Power a division of PacifiCorp (“Rocky Mountain Power” or “Company”) filed an Application requesting the Commission approve or reject an amendment to a Power Purchase Agreement (“PPA”) between the Company and Commercial Energy Management, Inc. (“CEM”). CEM owns and operates a 900 kW hydro-electric qualifying facility under the Public Utility Regulatory Policies Act of 1978. CEM and Rocky Mountain Power entered a PPA on November 21, 1991, which expired May 31, 2020. CEM and the Company are in the process of negotiating a replacement contract for the sale of energy and capacity and a separate standalone contract that addresses interconnection requirements. In the interim, the Company and CEM agreed to extend the current PPA from June 1, 2020 through February 28, 2021, with updated pricing for energy sales during the extended term. STAFF RECOMMENDATION Staff recommends the Commission process the case by Modified Procedure with a 45-day comment period and a seven-day reply comment period.
