HomeMy WebLinkAbout20181002_ej2.pdfDECISION MEMORANDUM TO:COMMISSIONER KJELLANDER COMMISSIONER RAPER COMMISSIONER ANDERSON COMMISSION SECRETARY COMMISSION STAFF LEGAL FROM:EDWARD JEWELL DEPUTY ATTORNEY GENERAL DATE:SEPTEMBER 20,2018 SUBJECT:APPLICATION FOR APPROVAL OF THE ASSET PURCHASE AGREEMENT BETWEEN ROCKY MOUNTAIN POWER AND THE CITY OF IDAHO FALLS -HOLMES DRIVE;PAC-E-18-06. On July 23,2018,Rocky Mountain Power filed an Application requesting authority to transfer certain rights and obligations to serve Century Link and Cable One communications facilities to the City of Idaho Falls as part of a road-widening project undertaken by the City. Rocky Mountain Power submits its Application for approval under the Idaho Electric Supplier Stabilization Act,I.C.§61-332,et seq.,and the electric utility asset transfer statute,I.C.§61- 328.Application at 1.The latter statute states the Commission "shall issue a public notice and shall conduct a public hearing upon the application." On September 11,2018,the Commission issued a Notice of Application,Notice of Modified Procedure,and Notice of Telephonic Hearing.Order No.34142.In the Notice of Telephonic Hearing,the Commission set a telephonic public hearing for 11:00 a.m.on October 16,2018.Since that time,scheduling conflicts have arisen and Staff now recommends that the telephonic public hearing date be changed. STAFF RECOMMENDATION Staff recommends that the Commission issue an Order that amends its previous scheduling order to reschedule the telephonic public hearing to October 18,2018.
