IPC-E-14-15 Clark Canyon Hydro, LLC (Clark Canyon) recently retained counsel, who requested a meeting with Staff and Idaho Power before filing comments in the case. Clark Canyon now moves to suspend the procedural schedule issued in Order No. 33782, to which Idaho Power and Staff do not object. In June 2014, Idaho Power Company filed an Application for the Commission to approve or reject its Energy Sales Agreement – for the sale and purchase of energy under the Public Utility Regulatory Policies Act (PURPA) – with Clark County. The Commission issued a Notice of Application and Notice of Modified Procedure, Order No. 33064, then suspended the procedural schedule, order No. 33088 after Staff discovered discrepancies between the Agreement and Clark Canyon’s Federal Energy Regulatory Commission (FERC) license. On March 31, 2017, Clark Canyon received a renewed FERC license. Clark Canyon and Idaho Power met with Staff on May 11, 2017, then jointly asked the Commission to lift the suspension and adopt an agreed procedural schedule, which the Commission granted. Order No. 33782. Clark Canyon subsequently retained counsel, with whom Staff and Idaho Power agreed to meet on July 6, 2017, prior to filing comments.
