MNV-W-16-02 On October 13, 2016, Morning View Water Company (“Morning View” or “Company”) provided a letter to the Commission requesting approval to defer and recoup costs related to a well system failure and flood as soon as possible. As a result of the well system failure and flood, the Company incurred certain expenses. Based on a letter the Company provided the Commission on December 6, 2016, the Company indicated it was pursuing warranties and guarantees from the designers and installers of the well system in order to offset potentially recoverable costs. However, no further information was provided. Therefore, on April 13, 2017, Commission Staff filed discovery in this matter, requesting potential deferred expenditures, future expenses, employee costs related to the failure, warranty and legal action information, engineering schematics and data, and a variety of other information for Staff to better understand the scope of the Company’s pending request. STAFF RECOMMENDATION Staff believes that the Company has now provided enough information to reasonably initiate these proceedings and recommends that the case be processed by Modified Procedure, with comments due within 21 days of the Commission’s notice, and reply comments (if any) due 7 days later.
