SUBJECT: FALLS WATER COMPANY’S APPLICATION TO INCREASE ITS BASIC
RATES AND CHARGES, CASE NO. FLS-W-09-01
On September 16, 2009, the Commission issued a Notice of Public Workshop and
Notice of Modified Procedure setting a deadline for comments to be filed no later than October 7,
2009. On September 30, 2009, Commission Staff filed a Motion to Suspend Deadline for Filing
Comments.
THE MOTION
Commission Staff contends that, due to the nature of this case (i.e., general rate case),
the request by Falls Water for a 14.39% increase in revenue, and the demonstrated interest already
exhibited by the public in the form of comments to the case, Staff will be unable to adequately audit
and review the Company’s Application prior to the October 7, 2009, comment deadline.
Staff requests that the Commission suspend the comment deadline until such time as
Staff can informally meet with the Company, establish a feasible schedule for the processing of this
case, and present the schedule for Commission approval.

such time as Staff can meet with the Company to establish a feasible schedule to be presented to the
Commission for approval?
