SUBJECT:UPDATING THE COMMISSION'SAFETY AND ACCIDENT
REPORTING RULE 101 BY ADOPTING THE 2007 EDITION OF THE
NATIONAL ELECTRICAL SAFETY CODE, CASE NO. 31-1101-0601
On October 4, 2006, the Commission caused to be published a Notice of Proposed
Rulemaking. More specifically, the Commission proposed to update its Safety and Accident
Reporting Rule 101 by adopting the 2007 Edition of the National Electrical Safety Code
(NESC). IDAP A 31.11.01.101. The Commission s AP A notice required that interested persons
submit comments no later than October 25 2006.
No person filed comments regarding the Commission s proposal to incorporate the
new NESC by reference. The Commission did receive a letter from Legislative Services
indicating that the Senate and House Subcommittees for Review of Administrative Rules had no
objections to the proposed rule.
COMMISSION DECISION
Given the lack of any adverse comments, does the Commission wish to adopt the
proposed rule as its pending rule? Does the Commission desire to publish its Notice of Pending
Rule in the January 3 , 2007 edition of the Administrative Bulletin and submit the pending rule to
legislative review in 20077
