WALKER DATE:SEPTEMBER 29, 2006 SUBJECT:IDAHO POWER'S APPLICATION FOR A CERTIFICATE OF PUBLIC CONVENIENCE AND NECESSITY FOR THE EV ANDER ANDREWS POWER PLANT - CASE NO. IPC-06- On September 29 , 2006, the parties executed a Stipulation (attached) agreeing to extend the deadline for Staff and Intervenors (ICIP) to file their direct testimony from October 2 2006 to October 10 , 2006. According to the Stipulation, this will allow the parties to review the responses of Idaho Power to Request for Production Nos. 50 and 52, as ordered by the Commission, prior to the filing deadline. The Stipulation states that the remaining dates November 6, 2006, for Idaho Power s rebuttal and November 20-, 2006, for hearing, will remain unchanged. The parties also agreed to shorten the time in which to respond to any discovery requests ofldaho Power from 28 days to 14 days. WALKER DECISION MEMORANDUM BEFORE THE IDAHO PUBLIC UTILITIES COMMISSION IN THE MATTER OF IDAHO POWER COMP ANY'S APPLICATION FOR A CERTIFICATE OF PUBLIC CONVENIENCE AND NECESSITY FOR THE EV ANDER ANDREWS POWER PLANT CASE NO. IPC-06- JOINT STIPULATION RE: EXTENSION OF PRE-FILE DEADLINE BACKGROUND On September 27, 2006, the Commission issued Order No. 30136 partially granting the Industrial Customers of Idaho Power s (ICIP) motion to compel. The Commission Ordered Idaho Power to answer ICIP's production requests Nos. 50 and 52 on or before October 2, 2006. ICIP is the only intervenor in this case. CURRENT SCHEDULE The current schedule for this case is as follows: October 2 2006 Staff and Intervenor pre-file of direct testimony November 6 2006 Idaho Power s rebuttal testimony November 20-2006 Technical Hearing STIPULATION The parties, by their signatures below, hereby agree to extend the deadline for Staff and ICIP to file their direct testimony in this matter to October 10, 2006, so that they may have time to review the response of Idaho Power to request for production Nos. 50 and 52 prior to the filing deadline. The parties also agree to shorten the maximum time in which to respond to any discovery propounded by Idaho Power from 28 days to 14 days. An objection to any discovery request shall be filed within seven days of service of the request. The remaining dates will remain as set forth above.
