SUBJECT:INTERVENTION DATE FOR THE TRIENNIAL REVIEW DOCKETS
On June 17, 2003, the Commission issued a Notice of State Proceeding and Notice of
Right to Intervene in Case Nos. GNR-03-22 and GNR-03-23. These cases were established
to examine the issues to be raised in the FCC's Triennial Review Order. In the Notice, the
Commission set an intervention date of June 27, 2003 for both cases. When the Notice was
issued, the expectation was that the release of the FCC's Triennial Review Order was imminent.
At this time the FCC's Order has not yet been issued.
On June 26 2003, Verizon filed a Motion For Extension Of Time In Which To Intervene
for both dockets. Verizon states that it cannot determine its need to intervene until the Company
has reviewed the FCC's Order. For that reason it has asked that the intervention date for both
cases be changed to ten days after the FCC has released its Order. Staff understands that other
carriers that have not yet petitioned to intervene will do so.
Staff believes that because the Triennial Review Order has not yet been released and to
encourage the widest possible participation in these cases that this is reasonable that the deadline
for intervention be set for ten days after the release ofthe FCC's Triennial Review Order.
Does the Commission wish to set a new intervention date in Case Nos.GNR- T -03-22 and
GNR-03-23 for ten days after the release of the FCC's Triennial Review Order?
