IDAHO PUBLIC UTILITIES COMMISSION
MINUTES OF DECISION MEETING
September 5, 2023 – 1:30 P.M.
In attendance was Commissioner Eric Anderson, Commissioner John R. Hammond, Jr. and
Commissioner Edward Lodge. Commissioner Anderson called the meeting to order.
The first order of business was APPROVAL OF MINUTES FROM THE PREVIOUS MEETING on
August 29, 2023. The Commission voted unanimously to approve the minutes as written.
The next order of business was CONSENT AGENDA:
2. Action Item: Michael Duval’s September 5, 2023, Decision Memorandum re: In the Matter of
Avista Corporation’s Application to Update and Establish Its Capacity Deficiency Period to be
Used for Avoided Cost Calculations; Case No. AVU-E-23-12.
3. Action Item: Chris Burdin’s September 5, 2023, Decision Memorandum re: In the Matter of
the Application of Avista Corporation, d/b/a Avista Utilities, Requesting Authority to Revise Its
Electric and Natural Gas Book Depreciation Rates and Authorize Deferred Accounting Treatment
for Difference in Depreciation Expense; Case Nos. AVU-E-23-02 and AVU-G-23-02.
4. Action Item: Chris Burdin’s September 5, 2023, Decision Memorandum re: In the Matter of
the Application of Rocky Mountain Power to Decrease the BPA REP Credit Effective October 2023
through September 2025; Case No. PAC-E-23-19.
5. Action Item: Michael Louis’ September 5, 2023, Decision Memorandum re: In the Matter of
Idaho Power Company’s Application for Approval of a Special Contract and Tariff Schedule 33 to
Provide Electric Service to Brisbie, LLC’s Data Center Facility; Case No. IPC-E-21-42.
6. Action Item: Michael Louis’ September 5, 2023, Decision Memorandum re: In the Matter of
Intermountain Gas Company’s Tariff Advice No. 23-02; Case No. INT-G-23-01.
Commissioner Anderson made a motion to approve Staff’s recommendations for Items 2, 3, 4, 5 and 6
under the Consent Agenda. A vote was taken on the motion and it carried unanimously.
The next order of business was FULLY SUBMITTED MATTERS:
7. Deliberation Memorandum re: In the Matter of Avista’s Application for an Accounting Order
Authorizing Deferral of Certain Costs Associated with the Montana Riverbed Lease Agreement;
Case No. AVU-E-23-06 [Adam Triplett, Attorney].
8. Deliberation Memorandum re: In the Matter of the Investigation into Whether VP, Inc. is a
Public Utility Subject to Regulation by the Idaho Public Utilities Commission; Case No. GNR-W-
17-01 [Adam Triplett, Attorney].
9. Deliberation Memorandum re: In the Matter of Veolia Water Idaho, Inc.’s Application for
Approval of Interconnection Agreement with the City of Meridian; Case No. VEO-W-23-02 [Chris
Burdin, Attorney].
10. Deliberation Memorandum re: In the Matter of United Electric Co-Op, Inc.’s Formal
Complaint for Violation of Contract Entered into Pursuant to the Idaho Electric Stabilization Act;
Case No. C15-E-23-01 [Chris Burdin, Attorney].
Commissioner Anderson stated that Items 7, 8, 9 and 10 under Fully Submitted Matters would be
deliberated privately.
Commissioner Anderson stated there was no further business before the Commission and the meeting was
adjourned.
