HomeMy WebLinkAbout20220809MIN.pdf IDAHO PUBLIC UTILITIES COMMISSION MINUTES OF DECISION MEETING August 9, 2022 – 1:30 P.M. In attendance was Commissioner John Chatburn and Commissioner John R. Hammond, Jr. Commissioner Eric Anderson participated via telephone. Commissioner Hammond called the meeting to order. The first order of business was APPROVAL OF MINUTES FROM THE PREVIOUS MEETING on July 26, 2022. The Commission voted unanimously to approve the minutes as written. The next order of business was CONSENT AGENDA: 2. Action Item: Riley Newton’s August 9, 2022, Decision Memorandum re: In the Matter of Gem State Water Company LLC’s Application for an Order Authorizing an Increase in Its Rates and Charges for Water Service in the State of Idaho; Case No. GSW-W-22-01. 3. Action Item: Chris Burdin’s August 9, 2022, Decision Memorandum re: In the Matter of Noah Kinne’s Formal Complaint Against Avista Corporation; Case No. AVU-E-22-08. 4. Action Item: Dayn Hardie’s August 9, 2022, Decision Memorandum re: In the Matter of the Application of Avista Corporation for Approval to Decrease Its Energy Efficiency Tariff Rider Adjustment Schedule 91; Case No. AVU-E-22-09. 5. Action Item: Chris Burdin’s August 9, 2022, Decision Memorandum re: In the Matter of the Fixed Cost Adjustment Mechanism (FCA) Annual Rate Adjustment Filing of Avista Corporation; Case No. AVU-E-22-12. 6. Action Item: Chris Burdin’s August 9, 2022, Decision Memorandum re: In the Matter of the Fixed Cost Adjustment Mechanism (FCA) Annual Rate Adjustment Filing of Avista Corporation; Case No. AVU-G-22-04. 7. Action Item: Riley Newton’s August 9, 2022, Decision Memorandum re: In the Matter of the Residential and Small Farm Annual Rate Adjustment Filing of Avista Corporation; Case No. AVU- E-22-10. 8. Action Item: Claire Sharp’s August 9, 2022, Decision Memorandum re: In the Matter of Avista Corporation’s Annual Power Cost Adjustment (PCA) Application; Case No. AVU-E-22-11. 9. Action Item: Michael Eldred’s August 9, 2022, Decision Memorandum re: In the Matter of Avista Corporation’s Compliance Tariff Filing – 2022 Rates Commission Order No. 35156; Case Nos. AVU- E-21-01/AVU-G-21-01. Commissioner Hammond made a motion to move Item 3 (Case No. AVU-E-22-08) under the Consent Agenda to Fully Submitted Matters. A vote was taken on the motion and it carried unanimously. Commissioner Hammond made a motion to approve Staff’s recommendations for Items 2, 4, 5, 6, 7, 8, and 9 under the Consent Agenda. A vote was taken on the motion and it carried unanimously. The next order of business was RULEMAKING: 10. Action Item: Stephen Goodson’s August 9, 2022, Decision Memorandum re: Notice of Adoption of Pending Rule – IDAPA 31.61.01 and IDAPA 31.81.01; Case Nos. RUL-U-22-01 and RUL-U-22-02. Mr. Goodson presented the Decision Memorandum and asked if the Commission wished to direct Staff to submit the necessary forms to publish a Notice of Rulemaking – Adoption of Pending Rule in the Administrative Bulletin. Commissioner Chatburn made a motion to direct Staff to submit the necessary forms to publish a Notice of Rulemaking – Adoption of Pending Rule in the Administrative Bulletin. A vote was taken on the motion and it carried unanimously. The next order of business was FULLY SUBMITTED MATTERS: 11. Deliberation Memorandum re: In the Matter of Clean Energy Opportunities for Idaho’s Petition for an Order to Modify the Schedule 84 100kW Cap & to Establish a Transition Guideline for Changes to Schedule 84 Export Credit Compensation Values; Case No. IPC-E-22-12 [Riley Newton, Attorney]. 12. Deliberation Memorandum re: In the Matter of Rocky Mountain Power’s Application for Approval or Rejection of the Power Purchase Agreement Between PacifiCorp and Georgetown Irrigation; Case No. PAC-E-22-06 [Claire Sharp, Attorney]. 13. Deliberation Memorandum re: In the Matter of Tami Thatcher’s Formal Complaint Against Rocky Mountain Power; Case No. PAC-E-22-09 [Claire Sharp, Attorney]. 14. Deliberation Memorandum re: In the Matter of Rocky Mountain Power’s Application for Approval or Rejection of the Power Purchase Agreement with Amy Family Holdings, LLC; Case No. PAC-E-22-08 [Claire Sharp, Attorney]. 3. Decision Memorandum re: In the Matter of Noah Kinne’s Formal Complaint Against Avista Corporation; Case No. AVU-E-22-08 [Chris Burdin, Attorney]. Commissioner Hammond stated that Items 11, 12, 13, 14 and 3 under Fully Submitted Matters would be deliberated privately.
