HomeMy WebLinkAbout20210928MIN.pdf IDAHO PUBLIC UTILITIES COMMISSION MINUTES OF DECISION MEETING September 28, 2021 – 1:30 P.M. In attendance was Commissioner Paul Kjellander and Commissioner Kristine Raper. Commissioner Eric Anderson attended via telephone. Commissioner Kjellander called the meeting to order. The first order of business was APPROVAL OF MINUTES FROM THE PREVIOUS MEETING on September 21, 2021. The Commission voted unanimously to approve the minutes as written. The next order of business was CONSENT AGENDA: 2. Action Item: Riley Newton’s September 24, 2021, Decision Memorandum re: In the Matter of Idaho Power Company’s Application for Approval or Rejection of the Third Amendment to Its Energy Sales Agreement with MC6 Hydro LLC; Case No. IPC-E-21-30. 3. Action Item: Erick Shaner’s September 24, 2021, Decision Memorandum re: In the Matter of the Application of Idaho Power Company for Approval or Rejection of the First Amendment to the Energy Sales Agreement with Shorock Hydro, Inc. for the Sale and Purchase of Electric Energy from the Rock Creek #1 Hydro Project; Case No. IPC-E-21-31. Commissioner Kjellander made a motion to approve Staff’s recommendation for Items 2 and 3 under the Consent Agenda. A vote was taken on the motion and it carried unanimously. The next order of business was MATTERS IN PROGRESS: 4. Action Item: Erick Shaner’s September 24, 2021, Decision Memorandum re: In the Matter of Idaho Power Company’s Application to Initiate a Multi-Phase Collaborative Process for the Study of Costs, Benefits, and Compensation of Net Excess Energy Associated with Customer On-Site Generation; Case No. IPC-E-21-21. Mr. Shaner reviewed the Decision Memorandum and asked does the Commission wish to adopt the schedule as written and issue a Notice of Modified Procedure. Commissioner Raper made a motion to adopt the schedule as proposed with the inclusion of an October 28, 2021, Telephonic Customer Hearing and issue a Notice of Modified Procedure. A vote was taken on the motion and it carried unanimously. 5. Action Item: Riley Newton’s September 24, 2021, Decision Memorandum re: Frontier Communications of America, Inc.’s Notice for Cancellation of Certificate of Public Convenience and Necessity No. 323; Case No. CZT-T-21-01. Mr. Newton reviewed the Decision Memorandum and asked does the Commission wish to grant the Frontier Company’s request for a waiver of the public notice requirements and issue a Final Order or issue a Notice of Application and Notice of Modified Procedure with a 21-day comment period and a 7- day reply period. Commissioner Raper made a motion to issue a Notice of Application and Notice of Modified Procedure with a 21-day comment period and a 7-day reply period. A vote was taken on the motion and it carried unanimously. 6. Action Item: Dayn Hardie’s September 22, 2021, Decision Memorandum re: In the Matter of Idaho Power Company’s Application for Approval of Its Load Curtailment and Interruption Plan; Case No. IPC-E-21-13. Mr. Hardie reviewed the Decision Memorandum and asked does the Commission wish to hold a hearing in this case pursuant to Idaho Code § 61-532. Commissioner Raper made a motion to decline to hold a hearing in this case. A vote was taken on the motion and it carried unanimously. The next order of business was FULLY SUBMITTED MATTERS: 7. Deliberation Memorandum re: In the Matter of Rocky Mountain Power’s Application to Increase the BPA Rate Credit Effective October 1, 2021, through September 30, 2023; Case No. PAC-E-21-18 [Dayn Hardie, Attorney]. Commissioner Kjellander stated that Item 7 under Fully Submitted Matters would be deliberated privately.
