In attendance was Commissioner Paul Kjellander, Commissioner Raper, and Commissioner Anderson. Commissioner Kjellander called the meeting to order. The first order of business was APPROVAL OF MINUTES FROM THE PREVIOUS MEETING on Tuesday March 3rd and 6th, 2020. The Commission voted unanimously to approve the minutes as written. The second order of business was CONSENT AGENDA: 2. Action Item: Joe Terry’s March 5, 2020, Decision Memorandum re: Avista Corporation’s Application for Authority to Enter into Credit Facilities Up To $500,000,000; Case No. AVU-U-20-01. 3. Action Item: Daniel Klein’s March 5, 2020, Decision Memorandum re: The 2018 Broadband Equipment Tax Credit Application for Millennium Networks, LLC; Case No. MNL-T-20-01. 4. Action Item: Daniel Klein’s March 5, 2020, Decision Memorandum re: The 2018 Broadband Equipment Tax Credit Application for Tek-Hut, Inc.; Case No. GNR-T-20-07. 5. Action Item: Daniel Klein’s March 5, 2020, Decision Memorandum re: The 2016 Broadband Equipment Tax Credit Application for TekFinity, LLC; Case No. GNR-T-20-05. 6. Action Item: Matt Hunter’s March 5, 2020, Decision Memorandum re: In the Matter of Idaho Power Company’s Application for Approval of an Energy Sales Agreement with Marco Power Company, for Sale and Purchase of Electric Energy from Marco Ranches Hydro Project; Case No. IPC-E-20-06. 18. Action Item: Matt Hunter’s March 5, 2020, Decision Memorandum re: In the Matter of Idaho Power Company’s Application for Approval of the Second Amendment to the Energy Sales Agreement for the Hazelton a Hydro Project; Case No. IPC-E-20-07. Commissioner Kjellander made a motion to move approve Staff’s recommendation for items 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 12, 13, 14, 15, 16, 17 and 18 under the Consent Agenda. A vote was taken on the motion and it carried unanimously. The next order of business was MATTERS IN PROGRESS: 19. Action Item: Dayn Hardie’s March 4, 2020, Decision Memorandum re: In the Matter of Rocky Mountain Power’s Application for Approval of the 2020 PacifiCorp Inter-Jurisdictional Allocation Protocol; Case No. PAC-E-19-20. Mr. Hardie reviewed his Decision Memo and asked; if the Commissioner wanted to issue a Notice of modified Procedure establishing an April 7, 2020 public comment deadline and an April 14, 2020 Company reply comment deadline. Commissioner Raper moved that; we issue a Notice of Modified Procedure establishing an April 7 Comment deadline and an April 14 reply deadline. A vote was taken on the motion and it carried unanimously. 20. Action Item: Joe Terry’s March 5, 2020, Decision Memorandum re: Teton Water’s Application to Authorize Debt for Purpose of Well Construction; Case No. TTS-W-20-01. Donn English presented the issue in Joe Terry’s absence he reviewed his Decision Memo and stated; Does the Commission wish to grant the Company authority to issue up to $450,000 in debt. Commissioner Kjellander moved; to hold for a time certain, that time certain would be our next Commissioner Decision meeting. A vote was taken on the motion and it carried unanimously. 21. Action Items: Edward Jewell’s March 6, 2020, Decision Memorandum re: Application of Idaho Power for Approval of the Capacity Deficiency to Be Utilized for Avoided Cost Calculations; Case No. IPC-E-19-20. Mr. Jewell reviewed his Decision Memo and stated, Does the Commission wish to dismiss the Company's Application in this case and direct the Company to resubmit the Application upon acknowledgement of the Company's amended 2019 IRP, as required by Order No. 33917. Or, Does the Commission wish to issue a Notice of Modified Procedure and give the Company, and any interested persons, 21 days to comment and 7 days to reply specifically on whether the capacity deficiency filing should be made at the time the Company files its IRP or at the time the Company's IRP is acknowledged. Commissioner Kjellander moved that; allow for a 14-day comment period for Idaho Power Company with a 7 day response that may be coming from other parties to the case. A vote was taken on the motion and it carried unanimously. 22. Action Item: Edward Jewell’s March 6, 2020, Decision Memorandum re: In the Matter of Idaho Power’s Application to Evaluate Schedule 84 –Net Metering; Case No. IPC-E-19-15. Mr. Jewell reviewed his Decision Memo and stated; Staff recommends the Commission suspend the effective date in this case for an additional sixty days, until May 15, 2020, unless the Company timely withdraws its Application. Commissioner Kjellander moved that; we suspend the effective date in the case until May 15, 2020 A vote was taken on the motion and it carried unanimously. The next order of business was FULLY SUBMITTED MATTERS: 23. Deliberation re: In the Matter of Teton Water & Sewer Company’s Application for Approval of Use of Emergency Reserve Fund Monies; Case No. TTS-W-19-01 [Matt Hunter, Attorney] Commissioner Kjellander stated that item 23 under Fully Submitted Matters would be deliberated privately.
