MINUTES OF DECISION MEETING
January 22, 2019 – 1:30 P.M.
In attendance were Commissioners Paul Kjellander, Kris Raper and Eric Anderson.
Commissioner Kjellander called the meeting to order.
The first order of business was APPROVAL OF MINUTES FROM PREVIOUS
MEETING on Tuesday, January 15, 2019. The Commission voted unanimously to approve
the minutes as written.
The second order of business was CONSENT AGENDA:
2. Action Item: Edith Pacillo’s January 18, 2019, Decision Memorandum re: Agreement
with the Office of Energy and Mineral Resources for Western Interstate Energy Board
Dues.
3. Action Item: Edward Jewell’s January 18, 2019, Decision Memorandum re: In the
Matter of the Application of Idaho Power for Approval or Rejection of an Energy Sales
Agreement with J.R. Simplot Company-Pocatello Cogeneration and Small Purchased
Power Project; Case No. IPC-E-19-01.
Commissioner Kjellander made a motion to approve Staff’s recommendation for items 2 and 3
on the Consent Agenda. A vote was taken on the motion and it carried unanimously.
The next order of business was MATTERS IN PROGRESS:
4. Action Item: Sean Costello’s January 18, 2019, Decision Memorandum re: Application
of Newmax, LLC d/b/a/ Intermax Networks for Designation as an Eligible
Telecommunications Carrier; Case No. NEW-T-18-01.
Mr. Costello reviewed his decision memo and stated; does the Commission wish to grant or deny
the Tribe’s petition to intervene, does the Commission choose to convert this case from Modified
Procedure to a Technical Hearing docket or another path.
Commissioner Raper moved to grant intervention with all of the standard caveats not to unduly
broaden the issues in the Case, immediately issue a notice to extend the Comment deadline from
the now expired January 8th date to 14 days from the issuance of the Order, give seven days for
the company to comment and also, specifically deny the Tribes motion for a Technical Hearing
because they have not presented any issue that would warrant procedural direction. A vote was
taken on the motion and it carried unanimously.
5. Action Item: Karl Klein’s January 18, 2019 Decision Memorandum re: Idaho Power
Company’s Tariff Advice No. 19-04 (Annual Compliance Filing to Update Substation
Allowance Under Schedule 19, Large Power Service).
Mr. Klein reviewed his decision memo and stated; Staff is recommending that the Commission
treat the company’s Tariff advise as an application and issue a Notice of Application and Notice
of Modified Procedure that suspends the proposed effective date and setting a February 19
Comment deadline and February 26, 2019 as a reply deadline.
Commissioner Raper moved that, the Commission suspend the company’s proposed effective
date of February 1 and set a February 19 Comment deadline and a February 26, 2019 Reply
deadline.
Commissioner Kjellander stated, there was no further business before the Commission and he
adjourned the meeting.
