HomeMy WebLinkAbout20180103MIN.pdfIDAHO PUBLIC UTILITIES COMMISSION MINUTES OF DECISION MEETING January 3, 2018 – 1:30 P.M. In attendance were Commissioners Paul Kjellander, Kristine Raper and Eric Anderson. Commissioner Kjellander called the meeting to order. The first order of business was APPROVAL OF MINUTES FROM PREVIOUS MEETING on Wednesday, December 18, 2017. The Commission voted unanimously to approve the minutes as written. The second order of business was CONSENT AGENDA: 2. Brandon Karpen’s December 27, 2017, Decision Memorandum re: Avista’s Annual PGA Filing; Case No. AVU-G-17-06. 3. Camille Christen’s December 28, 2017, Decision Memorandum re: The Application of Intermountain Gas Company for Authority to Implement an Infrastructure Integrity Management Mechanism; Case No. INT-G-17-07. 4. Daphne Huang’s December 28, 2017, Decision Memorandum re: Renewing Contract with John Coyle to Assist in Litigation before FERC, Case No. FER-E-17-01. 5. Bentley Erdwurm’s December 28, 2017, Decision Memorandum re: Avista Corp. – Compliance Filings: 1) AVU-E-17-01 – Application for Approval to Increase Rates and Charges (Electric Service); 2) AVU-G-17-01 – Application for Approval to Increase Rates and Charges (Natural Gas Service). There were no questions and Commissioner Kjellander made a motion to approve Staff’s recommendations for items 2, 3, 4 and 5 on the Consent Agenda. A vote was taken on the motion and it carried unanimously. The next order of business was MATTERS IN PROGRESS: 6. Daphne Huang’s December 22, 2017, Decision Memorandum re: Idaho Power’s Application to Approve Asset Sale to City of Meridian; Case No. IPC-E-17-17. Ms. Huang reviewed her Decision Memo, she stated the Commission staff has made a recommendation to set a Public Hearing to hear this case. Commissioner Raper made a motion; to issue a Notice of Application and a Notice of Deadline for Comments on January 25, 2018 with a response deadline of two weeks following the January 25th deadline and issue a Notice of Public Hearing in the matter. Commissioner Kjellander asked if there were any further questions. There were no further questions and Commissioner Kjellander moved to grant the motion. A vote was taken on the motion and it carried unanimously. 7. Camille Christen’s December 28, 2017, Decision Memorandum re: The Application of Rocky Mountain Power for Approval of a Power Purchase Agreement between PacifiCorp and the City of Preston, Idaho; Case No. PAC-E-17-14. Ms. Christen reviewed her Decision Memo, she stated that Commission staff is recommending a Notice of Application and a Notice of Modified Procedure with a twenty one day comment period and a fourteen day period for reply comments. At the time her memo was written she had not chance to speak with staff about the request in the application that the Commission continue to purchase the output under the QF under the terms and the conditions under the prior agreement that expired on December 31, until the new PPA is approved or rejected and the prices would be trued up; she had since heard from staff that this is fine as long as the prices are trued up. Commissioner Raper moved that the Commission issue a Notice of Application and a Notice of Modified Procedure with a twenty one day comment time frame and a fourteen day reply that follows the comment deadline; with the caveat that the orders reflect that costs and prices will be trued up following the issuance of the final order in the case. Commissioner Kjellander asked if there were any further questions or comments. There were no further questions and Commissioner Kjellander moved to grant the motion. A vote was taken on the motion and it carried unanimously. The next order of business was FULLY SUBMITTED MATTERS: 8. Deliberation re: Avista’s Compliance Filing to Update Load and Gas Forecasts and Establish Capacity Deficiency for use in Avoided Cost Calculations; Case No. AVU-E-17- [Daphne Huang, Attorney] 9. Deliberation re: Idaho Power’s Annual Compliance Filing to Update Load and Gas Forecasts; Case No. IPC-E-17-15. [Daphne Huang, Attorney] Commissioner Kjellander announced that items 8 and 9 under Fully Submitted Matters would be deliberated privately. The next order of business was EXECUTIVE SESSION MATTERS: 10. Pending or imminently likely litigation, per Idaho Code § 74-206(1)(f), in FER-E-17-01, Franklin Energy Storage, LLC one through four, Petition for Declaratory Order and Enforcement under PURPA, FERC Docket No. EL18-50-000, et al. Commissioner Kjellander made a motion to adjourn into Executive Session and cited Idaho Code § 74-206(1)(f). He stated that the purpose of the Executive Session would be to communicate with the Commissioner’s attorneys about pending litigation, FERC Case No. EL- 18-50-000. A role call was taken and they adjourned into Executive Session. The Executive Session began at 1:38 p.m. and ended at 1:57 p.m. Commissioner Kjellander reconvened the regular meeting at 1:59 p.m. He stated that there was no further business before the Commission and he adjourned the meeting. ____________________________________ ______________________________ COMMISSION SECRETARY DATE OF APPROVAL
